I purchased a dealership in September 2011 from Severe Weather Pods, Inc. to sell fiberglass and steel storm shelters.  I purchased 3 shelters and paid for them and the dealership fee of $1200 in September, 2011.

Two of the purchased shelters were delivered to me @ 4 weeks after my payment.  I was told by the owner, Scott Bales, via email that the company sells @80 fiberglass shelters per week, leading me to believe this would be a profitable venture and I subsequently spent approximately $20,000 purchasing advertising for this business.  My business plan was to sell 1 shelter per week with a profit of $2000 per shelter, per Scott Bales' predictions.

I was told by other dealers they did not sell any steel shelters, only fiberglass.  Dealer from Virginia told me he sold approximately 4-5 fiberglass shelters per month, but had not sold any other types of shelters.

I did not receive the third shelter despite repeated inquiries from me.  March 2012, I received an email that said, "as of today, SWP will no longer be selling fiberglass storm shelters."  My contract said I would receive at least 30 days written notice of product changes.

I emailed SWP and stated, due to your recent business change, I believe we must cancel my order for the third fiberglass shelter (they are no longer offered) and you can refund me that amount of money.  At that time, I will place an order, depending on customer demand, for a steel shelter to complete my contract.  I look forward to working with SWP, despite the change in product and I will work to promote these new steel shelters.

I received another email that said my dealership has been cancelled.

I discovered after this event that SWP did not even manufacture the fiberglass shelters.  That they, in fact, purchased them from a secondary company and passed them off as their own production.  They are a scam in that they cannot offer what they sold a dealership to sell.  I never received the 3rd shelter. The dealership agreement was to sell fiberglass shelters. Scott Bales stated they sell 80 fiberglass shelters per week, when, in fact, he sold possibly 1-2.  He is a liar and a con artist.  He sold me something that could never have been successful.  I could never sell even the 3rd shelter, because they could not supply that shelter.

This is what Terri received when my staff decided not to keep her as a dealer because of complaints of the people she was quoting.

She was fully refunded, very quickly after my staff decided to take her dealer lisc away. Also in our contract with her, what she did here posting this is defamation of business and character, and in her contract she agreed and signed that she agreed to our terms or would be liable in texas court system for the above.

Copies of checks attached.

Scam

Hello Scott.

You are misinformed.  Yes, I received a refund for the 3rd shelter that my company ordered.  I never stated otherwise. And this report is not "trash talk", rather it is the truth.   I received the refund only after 6 months of not receiving that 3rd shelter.  SIX MONTHS for a delivery date???  For something that you reported you kept in stock.

I sold the 2 fiberglass shetlers very soon after I received them.  I advertised, emailed returned quotes, completed everything on your list of "good" dealer requirements.  Went beyond the call of duty for a dealership.

I had many, many interested parties, however, I could not get any shelters delivered from you.  Regardless of how many I could sell, YOU could not deliver.  YOU finally said you couldn't deliver and were discontinuing production of those fiberglass shelters, (a lie because you in fact did not manufacture any fiberglass units - but rather bought them from another party)  Even though the fiberglass units were the only ones you sold, per your own staff, you discontinued their sales.

How could you have a "dealer" with no product to sell????

You say you sell the steel shelters, but the only people who have actually bought any of these steel shelters are your own family and friends.

You are a total fraud.  You have no products to sell and are selling dealerships with false predictions of sales.  When discussing potential sales your email to me said and I quote directly from your email when you referred to sales, " That 60-80 figure is PER WEEK during summer not per month, i mis read it..

We sell more steel then glass, right now we are extremely backed up in steel shelters and giant bunkers, extremely.. been adding staff like crazy..

From Scott..

How could you sell 80 fiberglass shelters per WEEK when you could not deliver ONE to me in 6 months?

Have your attorney call me.  Your are the one who will be receiving a call from the state attorney general for being a complete and total fraud.

Why not post a copy of the cancelled check if your refund post is true.

Terri Dealer in Indiana

AUTHOR: DEB LLC - (United States of America)

POSTED: Sunday, July 29, 2012

Unfortunately for Terri, this is untrue what she reported here on this website about our company.

We have a signed legal release from her, when she was refunded on her 3rd unit that states she is paid in full. and also states that she would not trash our company, I will upload the document from our lawyers.

We did not feel that Terri was a very good dealer, and i am sorry to post that on you Terri, but obviously after you got a check from us, when my team decided to take your dealer lisc away, you were paid on your unit, and signed papers in order to get your check.

So this is NOT true, and the 2 units in her yard were still there, the 3rd unit which we were planning on tossing on another truck(free 1500$ delivery paid by us), which she was aware.

Since she signed a agreement to be released as a dealer, AND got fully paid back for the 3rd unit that we decided not to deliver, because we discontinued fiberglass and went to all steel storm shelters because they are stronger, and still filled out a report on us, i have no choice but to file legal charges on her to protect our very good and strong reputations.

Normally if we have a weak dealer or a troublesome unable to sell product, we let their 1 year run out and not resign them up, but we made a decision as a company to remove her, and refund her 3rd unit buy in. There is a buy in so a dealer has stock on hand, and not just saying they do. We delivered 2 of the units, we decided not to carry glass anymore, and decided that we didnt want her to be a dealer anymore. We dont owe her a dime, and are filing legal charges for anything she is saying about our good company.

If you are a customer reading her false statement, in which she is trying to get back at us for removing her as a dealer, please call our legal department.
