Shapes Total Fitness Non disclosure of contract agreement, not giving you a copy of the contract just receipt. Set up automatic payment each month & had the bank take the month payments out on the 3 /4th of each month sta Internet

I have been a member of Shapes Fitness in Brandon, Florida for over ten years and have referred several friends and co-workers to this gym.  I have always paid my gym fee all upfront in cash but this year the gym personnel talked me into doing an automatic bank draft payment because she told me I would get a better deal and could only get this deal if I had it set up to automatically be withdrawn from my bank account.   The monthly fee started to withdraw in April 2012 of this year and thru July 2012 on the 3rd or 4 of each month and I had this confirm with the bank.  Then this month, August, they tried to withdraw on the 2nd of the month and because my pay did not go in until the 3rd I was assess a late fee of $28.00 and they also took out my monthly fee the the day before they took out the $28.000 late fee.  I called the local gym where I had my membership in Brandon, Florida and they said they cannot do anything about payments and to contact the National Office at  1-800-658-7727 and they are called National Fitness who handles the payment for Shapes.  They said it was in the contract that I would get charge a late fee of $28 and they could not do anything about it. I told the customer service person that each month starting in April the bank withdraw should be on the 3rd or 4th and not the 2th of each month.  She again said she could not do anything about it, everything is in the contract and I could not cancel it.  I was very frustrated as the local gym where I go did not state that it would come out the 2nd since I told them my pay would not come in until the 3rd of each month and that is how they said it was suppose to come out each month but they cannot do anything about it since all the payments is handled by the National Fitness.  So my loyalty of 10 years do not mean anything, we are just $$$$ to the gym.
