Sherry Waite refused to do a walk-through before the rental agreement was completed. Bathtub didn’t drain, light fixture was broken, the pond was dangerously mildewed, there was lumber and aluminum in the yard. Despite the fact that we included all the debris was present in the “Original Condition Report,” Sherry Waite explained that it was “our fault” that the property was in the condition it was in such bad repair. There was a terribly maintained fence on the property which was falling over. A tree fell on the fence and she maintained that it was also our fault. She would consistently come over while we were not home with no notice and wander through the house.  When we gave her our 30days notice, she began fixing things (at her expense) while we were not at home. She then claimed those broken things were broken by us and then attempted to hold those expenses out of our deposit. Not only did she refuse to return our deposit but she demanded even more money above the deposit. We then complained to her broker Berkshire Hathaway about her activities, (despite repeatedly making ½ of the commission) they explained “she was ONLY their agent and that “we were on our own.” Since she failed to do a walk-through she did not explain how to turn on any landscaping watering system, she then claimed that “we destroyed her landscaping.” We had to sue her personally, Berkshire Hathaway, and Shelby LLC for the deposit and the punitive damages for our time. DO NOT RENT FROM THIS WOMAN or have anything to do with Berkshire Hathaway in La Jolla, CA !!!  The Broker knows about this woman’s criminality but continues to sponsor her anyway.
