Well it all started with getting a call from Lynn telling me that they had been trying to get in touch with me for a month, I never got any call from them prior! She told me that because they havent heard from me that they were reporting me as a refusal to pay my debt. I tried to have her understand that I never got any calls from her and she just ignorned me. I asked if I could pay monthly and she said no, and that it had to be paid in full.She told me I could be going to jail soon if I didnt pay. She also said that if I did not pay that day then they would garnish my check from my employer and possibly garnish my husbands military check as well!!!!
Two weeks after we spoke she called me again , I told her I couldnt pay the full amount and she again said that I would be going to jail for a felony and that it was nothing I could do at this point but pay what I owed. I asked her what my balance was and she said that she doesnt know! When I asked her again about making montly payments on my account she hung up on me. When I called her back she said she was tired of talking with me and that it was nothing she could do for me! After telling her my situation she finally told me what my balance was, even though she told me she didnt know it before, and then told me a totally different amount then she did the first time she called me! After getting the run around with this Lynn lady she then told me that I needed to stop paying other bills and just pay Simm Associates because they are first priority! She also told me that she could see my bank account online and see that I have direct deposit coming into my account -which I didnt. And she also told me that she could see that I was paying all my other bills like utilities, rent, and car payments too, so I should have no problem paying Simm Associates. She told me to stop paying my car payment and just settle the debt with them and be late on my car payment! How Crazy!
I thought this was weird so I got off the phone with her and decided to call their main line and ask for their company information. Well the girl that answered gave me their name and Delaware. I then asked her for their full physical address and number and she hung up on me!

What this caller did threatening you like that is not right if she calls again tell her what she can kiss then hang up. If fact you do not have to talk to them at all . If you have caller id and see that # do not answer the phone besides they cannot touch your wages

But no call back - they are a bottom feeder collection agency
You cannot be arrested for debt period - been there done that - sued and WON
Just send them a cease communications letter via certified mail with return receipt requested - keep copies
When the call (and they will with the same message It is very important blah blah)
Let the machine or voice mail take it - make a copy on a tape recorder and take a picture of the caller id (my attorney taught me this trick)

First of all, what they're doing is illegal. They cannot threaten you with jail. If I were you, I would report them to the FTC and the State Attorney General's office. If that doesn't work, then go out and get a lawyer and sue them.
Secondly, they have some nerve to tell you to forget your rent, utilities, and car payments and to pay them first! That's a bunch of bull! Your basic living expenses come first. What does this Lynn want you to do? Become homeless? Not have any utilities on and no transportation to get around.
That's what really bothers me about collection agencies. They expect you to return their calls in a flash like it's a matter of life and death.
I remember this one day seven years ago, this one guy left a message on my answering machine and he demanded that it was "imperative" that I return his call. I left for him one really nasty message and to me, this wasn't really essential.
Another collection agency kept on calling me and said that "it was essential that I return the call". I did, and I spoke to a supervisor about this and she said, "Well all bills are essential, ma'am."
What I have done is this: I first pay for what is priority, such as my rent, cellphone bill, medical insurance, life insurance, food, transportation, and my prescriptions. Anybody else that I owe money to is just simply going to have to wait. And if I do send them anything, I send it to them on my time, when I'm able to, and that's that. There is really no need for me to return these bill collectors' calls. Keeping a roof over my head, food in my stomach, my electric bill and my cellphone bill on, my prescriptions and insurance coverage of my medical bills is way more important than some past due credit card bill or anything else that I owe that I feel is not priority.
If any of these collection agencies ever call you again, do not return their calls. Even if you do pick up the phone, tell them that they'll get their money when you get it to them and that's that! Put your living expenses ahead of everything else. And if you ever deal with Lynn again, ask her how she would feel in being homeless and out on the streets; simply because she told you to pay them first instead of your rent or mortgage, your utilities, and so forth. You don't have to deal with people like that!
If you have an answering machine or caller ID, then just simply screen your calls. When these bill collectors call, don't answer your phone.
Collection agencies "may be doing their job", but you don't have to return their calls.
