Simon's Agency Phillip Bova and Attorney Frank Fabiano Simon's Agency Files False Negative Reports to Major Credit Bureau's On Unsuspecting Consumers Liverpool New York

On or about December of last year (2015) I went to obtain a Mortgage and was told by my bank that I did not qualify due to a negative item for 192.00 showing delinquent on my credit report. I immediately contacted Simon's Agency of Liverpool N.Y. who was the reporting agency.

I was told by a Mr. Jim Fazzini that I was to immediately pay or that the item was "never going to come off of my credit report". I immediately sent them a certified letter asking them to validate the debt by showing something that would adhere me to such a debt ie. (a wet ink signature or some type of contract) to no avail. I then sent out a second certified letter again asking the to cease and desist until they can prove the existence of the alledged debt.

I was told that the debt was the result of some type of Doctor visit that never took place. Mind you, I live three counties away and approximately a 2 and a half hour drive and have never even visited any of these people. I was only left with the option of filing a small claims case in my local court for Fair Debt Collection Act Violations and also Fair Credit Reporting Act Violations. The total amount of these violations are $3000.00. The Judge in this matter threw out the case because I was told I must file in their County (Onondaga) and that our local court did not have jurisdiction over the matter. 

This began to make me think that if this false reporting on my credit reports could happen to me, then there are probably other victims out there that have had their financial life ruined by this agency. 

I put a few feelers out on social media and have found another victim of this money grab scam. She has 13 false negative items placed on her report by this same agency and has also been trying to get them to properly validate the alleged debt, to no avail. I feel the only way to get relief from this horrible situation is to possibly file a Federal Class Action against Simon's Agency of Liverpool N.Y. If there is anyone else out there that has been defamed throught the reporting of false negative items on their credit reports, please message me.

I have found a Law Firm that specializes in Federal Class Action suits and they are willing to accept this case. Also the Attorney Francesco Fabiano of Syracuse N.Y. is part of this scam and he is an officer on several Arizona based companies supposedly specializing in credit counseling. If anyone out here has has any dealing with either Simon's Agency of Liverpool N.Y. and or Attorney Frank Fabiano of Syracuse N.Y. please contact me so we can stop these scammers!
