   On November 19th an "order" was placed with The Smart Store for one laptop and one desktop computer.  We had actually done business with them in the past and were pleased with their services.  Following my signing a contract, I noticed it stated that the paperwork indicated that the merchandise had been "recieved".  Not the case, both items had to be ordered, however, due to the urgent nature of my order, I was assured they would arrive by the following Monday.  The contract was thrown away, and a copy of a "sales receipt" was handwritten on by the manager.  It read:  Order contract only - will print received contract upon received product" along with his signnature.

   So Monday...  No order received... Tuesday.. Nope... Wednesday... uh-uh.  When I returned to their store Thursday, they could not even produce proof that my order had been placed.  So, I cancelled my order, went out and purchased what we needed.  I was nevered called regarding my order.  I never received any merchandise and as far as I was concerned considered it cancelled and over.  

   A short time after Thanksgiving, I notice strange activity on my bank account.  It's a payment being drafted by the finance company we had used when we purchased an item from them in the past.  So I called the third party.  They stated that they had received a contract showing I had received the merchandise and my payment was due.  I explained the situation and how it unfolded, they stated they had not received any other paperwork from the retail store stating a cancelled order, and that the store had already been paid for the merchandise.

I went to the store looking for a rememdy, letting them know they needed to send in a cancellation letter to the financial group explaining my order was cancelled or refused or whatever.  Never done.  I continue to receive harrassing calls and threatening lettters from the third party financial group.  I turned this over to my wife, as I don't have the time or patience to handle stupid.

My wife's first call to the SmartStore went ok.  The man who answered the phone said he would let the manager know.  She requested a cancellation letter be sent to the finance company. (the finance company directed us to file fraud charges) In addition she advised them of what we were being directed to do and that she would call prior to taking any action.

My wife's second call to the SmartStore, they were very short and refused to discuss it with her - said they could only speak with me.  So, being as busy as we are... it got put in our pile of to-do's.

Today, my wife called letting them know that the calls and letters from the finance company were continuing and it was causing alot of stress as they are threatening legal action against us, and we've never even reeived the merchandise.  Again, they refused to speak with her.  Then she gets a call back from an exremely rude loud mouth, who continued to ask her why she keeps calling, they have nothing to say to her and anything she has to say is irrelevant as they can only speak with me.

Our remedy: A notarized letter authorizing my wife to act on my behalf will be generated tomorrow.  Fraud charges on Thursday possibly filled with a small claims for the $25 of mine they have and the stress they have cause both my wife and I unnecessarily.
