BEWARE!!!!

I moved in February 2010 and moved out in May 2012.  I paid all monies on time, even early oftentimes.  Throughout my living there, the back sliding glass door never shut all the way or ever locked.  The dishwasher never worked.  The garbage disposal never worked.  The carpet was heavily stained and torn up in areas as it looks to be about 20 years old.  The tack strip would stab your feet through every walkway.  I have called numerous times to have these issues fixed, but nothing was ever done.  Hardly even a phone call was returned - a week later - when these concerns were communicated.  They would always just brush me off and try to make it seem like I was just whining.  I was actually told to fix the disposal myself.  Once, I misplaced the key to the onpremises storage closet.  When calling to get a replacement key (as stated in the lease to do), I was told I am on my own and suggested to replace the deadbolt myself - which I did.  That is NOT what the lease says.  It states, "In the event Tenant loses or misplaces keys to the premises, Tenant alone is responsible for regaining access by traveling to Landlords office for a key".  

 At the time of moving out, I cleaned this place, top to bottom, cleaned WAY better than I found it.  I shampooed the carpet.  I even went as far as taking apart the oven hood and cleaned that out as well.  I turned off the power and turned in the keys.  I got a credit from the energy company and told me I overpaid (which I was very well aware of) after I turned off the power.

 Kevin Smith of Smith Real Estate, Inc. mailed an itemized bill with only about half of my security deposit 3 days before his deadline to comply with the law.  He charged $80.00 for interior cleaning, $120.00 for carpet cleaning, and $41.00 for my supposed "unpaid" power bill.  There is no way he cleaned the carpets as I turned in the key the evening of the last day of the month and the next guy moved in the very next day.  I know this because I personality talked to the next guy moving in when I turned in the key and the power was still turned off at time of transition.  I called 4 times to discuss - 3 messages and two weeks later - He claims I owe him all the money even though he could not explain why.  When disputing the energy bill (with written proof from the energy company) Kevin Smith says it is due because I turned off the power before the last day of the month.  He says that is why I owe $41.00 for the energy bill.  He said it is a fee and mine to pay since they put the account back into the name of Smith Real Estate.  Really - I move out and turn off power and I get charged $41.00 after I get a refund back from the energy company?  So, this guy has clearly more than earned his place here on ripoffreport.com.
