Southern Cross Wireless placed flyers on vehicles in parking lots and in the local news paper advertising a customer appreciation day on Sat. Oct. 29th.  This flyer stated all sorts of discounted and FREE items. No where on this flyer were any disclaimers, provisions, or qualifying rules and regulations.

What caught my eye was Trade in your I-Phone and get ANY Android FREE!!! Being that I recently dropped mine and cracked the screen and was not due for an upgrade until Feb of 2012, I decided I would take up the offer to trade in my I-Phone for a FREE Android. That way I would have a new phone without having to sign up for another 2 year contract.

I walked into the store 9:18am and was greeted nicely by a young salesman with a "good morning, may I help you"? I then told him I was there to look at the different Android phones and was wanting to trade in my I-phone for one. It was then that he said all the Androids were free with a i-phone trade in except the newly released Galaxy II S and if I would chose that one, it would be $100.00.

I then showed him the flyer that was in my hand, pointed to the advetisement and said "that's not what your flyer says, It says ANY Android FREE!!". He just looked at me silently for a few seconds and said the deals start at 10 O-Clock until 2 O-clock. Again I said that's not what your flyer states!! As I was walking out I told them they were going to have some angry customers today.

While getting into my car, the Retail Sales Manager Zikeya Martin walks over to me and says we will honor what the flyer says, but it doesn't start until 10 O-Clock. I smiled and said okay I'll be back later, thank you.

I returned at 1:20pm to pick out the Android phone and give them my I-Phone. While comparing the different Androids, I over heard an angry customer telling a salesman and I quote "that's not what is on this flyer, It says nothing about upgrades". The salesman acknowledges that he knows the flyer doesn't say that, but that is the only way you can get a free Android. The angry customer then stormed out the door stating "this is exactly why AT&T looses customers"!!!

The same salesman then approached me and asked if anyone has helped me, I told him not yet. I then told him what I was there for and he asked me "do you know if you are due for an upgrade or not"? I responded "I am eligable for one in a little over 3 months". He then said "sorry, but you don't qualify for a free Android. I showed him the flyer once again and he told me that it was no longer valid.

I asked to speak to the store manager and was then told and directed to get in line to speak to him.

I waited for a good 10 min before I was next to speak to the manager, when He called over a sales associate to take over for him. As he was walking away, I stepped out of the line and told him I needed to speak to him. It was apparent he wasn't happy with my stopping him from walking out of the store. I held the flyer up and pointed out where it read Trade in your I-Phone and get ANY Android FREE!!!  He responded with an arrogant attitude Okay, and? I told him that there were no provisions stated on your flyer and that this was false advertising. Again he responded in the same way. I then said "you do know that is against the law?" and one again he responded exactly the same, but added "have a nice day".

I didn't know what else to say due to him acknowledging, understanding, admitting and not caring that he was doing wrong. So before I walked away I told him "this will be reported". With a smile on his face he says well that's good, have a nice day.

By the way he had no name tag on and when he was asked for a business card he gave his Retail Sales Managers card.

are you going to file the same report? I believe this is he third time you've filed a report on the same incident. have you spoken with a lawyer or AT+T themselves about it?
