One name comes to mind in wrongfully addressing this complaint: Lisa Rossbacker. The individual goes by the title of President at Southern Polytechnic State University, and holds a position with the Board of Regents. But this is no reputable public figure. This individual should not be trusted by any organization.
This individual uses reckless disregard to deal with situations in which she has no experience, even when it is a matter of fiduciary responsibility.
This individual was made aware of a case in which I was ripped off for $1,200 for not rescinding charges on a meal plan contract with the school that could be canceled at any time, according to the terms. Ms. Rosbacker was contacted numerous times via email at rossbach at spsu.edu, which was carbon copied to Ron Koger at rkoger at spsu.edu (addresses exclude @ symbol for this report). This individual never responded, avoiding fiduciary responsibility in which her organization was legally responsible.
In addition to this complaint, further research reveals that several students were wronged in the same way, through an unauthorized charge that went unaddressed at the time of reporting.
Lisa Rossbacher disregarded a properly submitted complaint with knowledge that the contract I signed could be canceled at any time, that the school is legally responsible, including the service provider for committing a tort of wrongful interference with a contractual relationship. She further acknowledged that the meal plan was canceled due to inadequate service the semester prior to getting ripped off. She was made aware with external validation that the meal plan was never used. She even acknowledges that I was given the runaround through the bureaucracy of confusing department structures and that I had stepped foot into every office the school has. The complainant, is Southern Polytechnic State University and Lisa Rossbacher, had a fiduciary responsibility to follow up with a complaint in which her organization was liable by contractual obligation in which I have a legal standing.
But instead, Lisa chose to disregard the matter, hoping it would blow over. But now the extent of what I had to go through to sue the correct entity, The Board of Regents, and follow up on the matter is so outlandish that it warrants punitive damages, all at the direct cost to the State of Georgia.
Twice I contacted congress to determine the legal entities responsible.
Instead of responding to my emails directly, I one day received an email out of nowhere from someone named George Turner, who asked to schedule an appointment with me on the matter (just 2 weeks before he resigned). Mr. Turner tried to trick me into believing there was a window of cancellation disclosed on the contract when there clearly wasn't. Mr. Turner then told me that non response to my complaints with the Better Business Bureau is not such a big deal, and the threat of a lawsuit doesn't matter because the Attorney General handles their legal counsel for free.
Ms. Rossbacher was emailed again to inform that the person how came forward was not adequate.
I then filed an ethical misconduct report on Lisa Rossbacker twice, after the individual tried dismissing the first by saying that the problem was taken care of.
As a leader of an organization that is liable by direct contractual obligation to rescind charges for a contract canceled according to the terms, the correct thing to do is rescind the charges to the signee, and later follow up with the third party who has the money. It's just that simple. Hoping that the signee will give up or not press charges is so reckless, it doesn't happen outside the world of inexperienced students where consumers are more vulnerable. In this case, both the service provider and the school are now facing charges involving 10 times the amount of the stolen money in question, and that is just ridiculous.
