Having low back pain for a duration of 10 years and gradually worsening over time, I am now a candidate for lumbar surgery. This has been stated in numerous medical reports including two AME (Agreed Medical Examiner) reports. I have been shuffled around from doctor to doctor per the insurance companies request. After four years of excruciating pain, excessive pill dosage, painful epidural shots, and repeated attempts requesting surgery, I have complete disc collapse in my cervical spine.

Travelers finally approved the lower back surgery; but not with the physician they have been paying thus far. Here's the catch: they are now saying the neck is not part of the original injury therefore no physician will attempt lumbar surgery until the cervical spine is addressed. The evidence in all medical reports speaks of pain in his neck extremity. The persistent symptoms in this area, at times, have overshadowed my severe back pain.

The insurance company argues that I should see a doctor within the MPN (Medical Provider Network). Well, I have seen the doctors in the MPN over and over and still the runaround. My current treating pain management doctor is in the MPN and the surgeon that he has requested is not in the MPN. There is a transfer of care policy they are not honoring, and I was hurt before any MPN even existed.

My quality of life is nothing to speak of. I am unable to work because I am so medicated. I have depleted any savings I had. I am selling off everything I've worked so hard to build. My family is suffering the reprocussions of this whole mess.

The insurance company has all the evidence there proving my injury industrial related and they still give me he runaround.

I am a injured worker that was hurt in July of 2007. I had a MRI that showed blowed out disc and nerve veterbrate damage in my back I am in serious pain and just feel like a dog that needs to be shot. I did the physical therapy and the now up to 9 epidural shots each time receiving 5 shots per 9 times. That a total of 45 shots together. They sent me to see a designated doctor ordered threw Texas Workers Comp. Commission (TWCC) the doctor told me I needed to have surgery because the my back was so messed up and that no more therapy and epidural shots was really needed because they did nothing.

She also wrote in her report that I needed to get a surgery opinion own from a doctor of my choice and she wrote down that a L-5 S-1 PLIF with the 2 cages and plates and screws would be the ideal surgery. Okay so you ask what is the problem? Well after seeing a doctor of my choice and he agreed and said yes that is the surgery I would do and seeing the insurance surgeon and him saying the same thing and agreeing with the designated doctor and her report what would be the problem? Well the insurance hired another doctor a so called Physician Advisor and he disagreed with the designated doctor and the insurance surgeon and mine.

Now the insurance surgeon straight up told me in his office that he now doesn't want to do the surgery because of the workers comp. insurance comp. playing these games now, and signed and released me to the surgeon I picked for a surgery opinion yes this is good but I really had no problem with the insurance company surgeon he was honest nice and talked to me and my wife about every thing from start to end and was just a good moral and spirited person. The TWCC says that even when it gets to the point after all the appeals fail and we can get a court date in the TWCC court we would probably win they can still appeal the courts decision. So basically they can keep on appealing it as long as they want to .

I know that I have not been waiting as long as you I have been waiting since Jan. 2008 I have decided with a good lawyer here in Dallas to go ahead and sue the Company I worked for when I got hurt yes they are protected under law but the law also states they are still responsible for your injury once deemed valid by TWCC so there for the company can turn around and sue the Workers Comp. Insurance Company for not paying the surgery since they paid them to cover on the job injury's so just think about that and tell me what you think.
