In April 2009, I saw an advertisement on the t.v. for Start Positive Loss Mitigation. they are a company that is suppose to negotiate with your mortage lender to lower your interest rate and loan payment. I called them and they explained that it would only take 2 months or less. Their price was $1,450.00 which they said we could pay in several payments. My home loan was caught up, but I was having a little dificulty keeping it caught up, because of a layoff at work and my new job had taken away our monthly bonus because of inflation. Thay said they were 98% sure they caould get this done for me.

 They sent me my package and I signed it and sent it back, I was instructed not to make my monthly mortgage payments, because I needed to be behind on my payments befor they would approve my request. I was instructed not to talk to my lender, under no circumstances, they said they would do all the negotiations, and if my lender contacted me not to dicuss money or anything with them. I was told by several different people Robert, Brandy, Michelle, Ruby, Loni, and Jerry, not to pay my loan payments.They were very easy to get in touch with to begin with, but as time went on and things got sticky with my lender, I could no longer call and speak to anyone, I would leave message after message, and it would take them days to call me back.

My lender sent me a letter requesting more pay statements, I called Start Positive and they instructed me not to send them anything, that they had submitted all the information my lender needed. In about a month we received a letter from our lender, saying our request for a loan modification had been denied, because we failed to supply them with the information they requested. I contacted Start Positive, and they said for me to send them the letter and the pay stubs. I did, a week later someone called and said I needed to send the pay stubs, I sent them again along with the letter from our lender. another week passed and the same thing, someone else calls and says they need me to fax the pay stubs. Finally after faxing the stubs 4 times I requested the lady stay on the line and I would click back over to make sure she got them. She said she did.

In July 2009 we got a foeclosure letter from our lender. We called Start Positive and they said they could not foreclose on our home while it was in negotiations. We were constantly asking if we should make our monthly loan payment because it was taking so long, we told them we feared we would be denied and have to come up with all that money in one lump sum, they told us that they amount due would be placed to the back of our loan for us not to worry about it.

 In September 2009, we received a letter from an attorney representing our lender, saying we had to pay one lump sum or they were going to foreclose on our home. We tried and tried to contact Start Positive, after numourous messages, they finally called back and they told us again, that they could not foreclose on our home while it was in negotiations. 2 weeks later my neighbor called me and told me my home was in our local paper to be auctioned off on the court house lawn on Sept. 23, 2009. We called and called Sart Positive, we finally sent them an email and was contacted by Eric, who said he would call us. He did and when I explained it all to him, he told me I should have kept my payments up. I told him that Start Positive told me not to, and he said who, and I gave him a list of names and he acted like he thought they wouldn't tell me that. 

About a week later we received our original package we had emailed Start Positive attached with a letter telling us to resubmit our requests ourselves, that they would do it quicker if we submitted it. I called and called them, but noone would return my call and still hasn't returned my many calls I've made to them since Sept. 2009. I finally sent them an email telling them what I thought about them taking my money and not doing the job they were paid to do. There was no reply, now the emails come back, the website is no longer there, noone calls us back, nothing.

We submitted our package to our lender, oh did I tell you our lender is America Servicing Company, AKA Wells Fargo Home Mortgage. They called us and my husband offerd to catch up our payments and they said if he did, it would stop all negotiations with our loan motification. They set us up on a payment schedule in kinda of a contract, and lead us to believe that after we paid the 4 payments of $1,129.72 in Oct.2009 Nov. 2009 Dec.2009 and Jan. 2010. showing we could make our payments on time, which we did, that they would review our request again and if we did make the payments they would approve out request for a loan modification.

We made the payments as I have said above, and paid even before time each month, and have already made our Feb. 2010 regular payment, and I have been in contact with them every week since our last agreed payment and they acted like I would be approved, but I called them on February 23, 2010 and was told our request was denied and that I would have to pay a full lump sum of $4,500.00 or loose my home. The letter I received from them a few days later suggested I try to sell my home or contact HUD or some other community based agency for help. I called them and they said that they would work with me, but could not give me the assurance that they would not foreclose while I am trying to pay this outrageous payment, plus my mortgage loan.

I don't know what a person is suppose to do, noone can be trusted anymore. I have filed a complaint with the MD Attorney Generals Office, requesting our money back from Start Positive along with the other amount I owe on this aoutrageous amount I am exspected to pay ASC, but who knows how long this could take and even if I will receive anything to compensate my loss. Something needs to be done to these companies out here committing FRAUD and causing people to loose their homes.

Start Positive ended Negative for me and my family.

The people that owned Start Positive also own a debt consolidation company at the same address: www.clearoneadvantage.com. Contact them at (888) 785-5376 or (888) 768-4767.

If that doesn't work, their resident agent is John Baum, an attorney last listed at 36 South Charles Street, Suite 200, Baltimore, MD 21201.
