The State of Arizona has maintained for 2 years that my child's father has been in arrears, but they would not tell us where the arrears occurred. He has always been very prompt in his payments and I have never noticed an missing payment.
I had asked specifically, twice in writing, that the arrears charges be dropped, to no avail. DES continues to pester him for collection of the arrears, and has told me in almost no uncertain terms that it isn't my business.
My requests for clarification have gone completely ignored. The dad has now had his tax return confiscated, BUT, none of that money has come to me yet! Has the State of Arizona got a nice little slush fund going on? The dad has no problem paying money that is owed nor do I have any problem collecting it, but both of us would like to be very clear about where the arrears come from. We have had too too many experiences in the past with the State making mistakes to be comfortable accepting this at face value.

You and your EX are absolutely prudent to do what you have been doing.
DES routinely sends us letters stating that any potential refunds will be intercepted for arrears. There are, in fact, arrears, however the totals are misrepresented by more than $50k. No, this is not a typo.
I have written them countless letters explaining that this figure is mathematically impossible, and yet they'll correction always reverts back. This has been going on for more than 6 years!!

What has happened is you've assigned your rights (by accepting "enforcement" services) to the money over to a state agency (a "for profit" corporation) The money, just your families money. Some states even allow private businesses to get in on "enforcement" money handleing game.
Since ya'll get along you could stipulate (in a court of record) that the 2 of you will handle it on your own, Keep greedy state out of family Biz. (a suggestion-not legal advice)
Good luck... P.S if this works out please let me know, same problem everywhere across country (a little skimming here and there, nobody will notice.) and my ex still thinks the state "helps" families! Keep an eye on the money, it's your kids, not there's!
