Mercedes new owners BE AWARE! I owned couple Mercedes at the time, one of them was the ML430. Before the factory warranty expired at 50,000 miles, I brought my car into Auto Steigler for a complete check up before the warranty expired. The dealer came back and said how wonderful the car was, "still run like a champ!" according to them.
Well, what do you know; about 2,000 miles later as I was driving on Ventura Blvd., the car stopped in the middle of the street. It wouldn't accelerate ! ! I brought it Calabasas Mercedes for them to take a look of what was wrong. They said the tranmission gave up! I told them about the check up prior to the warranty. To make a long story short, no one at Calabasas Mercedes would help me and told me to bring it back to Auto Steigler, and so I did.
I told them to up the history of the last check up. They did, and said "Well, everything looked fine at that time!" Back and forth with them for days, nothing was done no one would help me. I ended up spending around $3,000 for a new trans and immediately sold both the ML430 and the S500. So, if anyone's planning to purchase a Mercedes, please make sure either you have full warranty or ??????:) Good luck to you all.

All parts manufactured for autos will eventually break. Some without warning. An automatic transmission such as yours(an AG 722.6) in your ML has as many parts as the rest of your vehicle combined. Any of these small parts can fail, rendering the trans useless.
The only way to predict an auto trans failure would be to completely disassemble and inspect the unit periodically for defects. You obviously can see where that is infeasible.
I'm sorry your trans failed, but Mercedes Benz technicians cannot see inside your trans (or engine, transfer case, or diff,for that matter).
If you were walking from the doctor's office after a checkup and broke your ankle on the way home, would he be resposible for not forseeing it?
After 2000 miles, any prior inspection would be invalid.
