Stellar Management Company Let others move into apartment that I had signed a lease for and paid deposit and rent for New York New York

My roommate and I signed our lease on 4/30/08 for a lease starting 6/1/08 for 300 Grand Street, Hoboken, NJ. We scheduled our move-in with the super for 6/5/08. Today our realtor called and told us there was a "situation".

The management company allowed people to move into our apartment on 5/30/08. The told the realtor they were expecting us "yesterday" 6/1/08 and tried to get ahold of us. However, no one did get in touch. Also, based on information the management company told my roommate, the others moved in on 5/30/08 anyhow.

The management company is telling us that the reason the others moved into our apartment is because their apartment was being renovated and they did not have the appropriate building permits. The management company tells us that their lawyers have reviewed the lease and they are protected. We disagree based on the lease. The only way they can delay our move-in is if our apartment is not able to be occupied --- but it is able to be occupied -- and currently occupied by others during OUR LEASE term!
