Similar to the other poster, we were also ripped off by these people a few years ago. We are one of the trade victims of Steve/Joanna Greer and Harvis Barklay Investments and want to warn communities to be vigilant and thorough when evaluating prospective renovators and builders. The Greers operate mostly in Toronto and the Greater Toronto Area (GTA). This particular builder’s jobs have been associated with extremely incompetent and intentionally negligent work, structural problems, work that is blatantly not to building code, a disregard for permit and inspection requirements, and an ongoing theme of not paying trades for work already covered by the client (resulting in angry trades visiting clients and liens on their home). The day you meet them could very well be the worst day of your life. Steve, Joanna and/or Harvis have been sued 20+ times in the past decade and have many convictions and judgements against them, including from Tarion Warranty. Recently my sources have alerted us to two new Tarion damage claim judgements against them for maximum allowable damage payments to the victims. They will now go after Steve and Joanna for these damages. They have at least 5 recent judgements that include court-ordered wage garnishment and writs for asset seizures against them. For example Joanna Greer had her wages ordered garnisheed at her employer iPro Realty in Nov 2017, as well as an order for the seizure and sale of their assets. Similar for Steve. They have approximately $250,000 in court judgements, fines, charges and convictions from City of Mississauga and Toronto, the Province of Ontario and Tarion Home Warranty Corporation – many of these are in full default as of June. They are currently being sued for approximately $2 million in a number of active cases that relate to construction fraud and negligence, also as of June. To our knowledge, some of the other trades that have been ripped off are: Lee Rocca Forming, Rock Concrete, Robcon Pools, Harwood, Homebridge, Pollard Windows, Braam’s Woodcraft, TAPS, Brock Landscaping, Imperial Trim, Safelink Security, Zetta demolition, several stair/railings companies. This doesn’t include a dozen smaller freelance trades. Feel free to call any of these businesses – John DaSilva at Rock Formation, Ray at Robcon, Brock at Brock Landscaping, Lee Rocca Forming etc.. I feel terrible for my fellow hard working peers that have had to suffer with people like this. Call Jim Camilleri, the president of Royal Canadian Legion Branch #82 in Port Credit, and ask him what Greer did to the Legion. Ripped them off for between $12,000 and $14,000. The Legion is a not-for-profit organisation for our ageing war veterans. If you know of anyone currently under contract with these individuals please make them aware of these details so that they can make informed decisions. If you have had work done by them you could still be eligible for damages under the Construction Act – call Tarion Warranty Corp ASAP. Many people aren’t aware of this option. The Greers likely didn’t register your home (which is illegal and something they’ve done many times) but you still may fall within the protection of the "Act”. Most of this is verifiable with the building departments in Mississauga/Toronto, court database judgements and rulings (be sure to check databases at each Superior court location - there are several and they don't necessarily share info), Tarion, or a simple phone call to any of the aforementioned parties (many have sued them). A thriving building industry has created a great opportunity for wrongdoing. We need to remind each other to be thorough with our due diligence when dealing with prospective trades, contractors and builders. The information on bad ones is often out there, folks just need to look for it - ie court records, reviews, BBB, Tarion. If a contractor like Greer drives you past "homes he has built” be sure to come back and knock on the door - put in the extra effort, it's worth it. Unfortunately references sometimes won't do - Greer's have lied as they were desperate to have their own ongoing construction improved. Sadly, many victims don’t come forward – a number of these victims said they consulted with a lawyer and were advised not to bother (Greer knows the system well and is slippery - being sued dozens of times will do that). The cost of litigation often far outweighs the reward, which works well for white collar thieves. If you steal a loaf of bread you can get arrested – steal $50,000+ and you can get away with it. We can thank a broken system for it - but it makes being careful all the more critical. Always two sides and yet you leave out many important facts.

You are quick to respond about the tarion appeal being denied through the BAF process but dont tell the full story. It is not over yet. In fact Tarions own words are "by way of background, BAF was set up to be a simplified forum for generally dealing with questions of whether or not items of construction are or are not warranted. It was not designed to address contractural disputes like finacial loss claims which would involve substantial discovery of documents, issues of credibilty and extensive involvement of the homeowner." They go on to say "these are issues and circumstances that the courts are better equipped"

The files we presented to Tarion for the appeal require much more involvement than what they made their decision on. They made errors not including hold back funds, assuming $85,000 payment from home owner actually was for finished products when they were items being finished with these funds so the client knew what would be completed before the next draws were due and money would be requested. They assumed a email by the home owner suggested they made the payment for $40,000 for electrical and plumbing rough in when it was not. They also took figures like back walk up for almost $50,000 and electrical replaced for over $20,000 as actual costs for these items without allowing the review of these contracts for the work that was actually done. So yes BAF was denied but it is not over. I will update this site on the next stage.

Then there is the case of all these court cases. Which you say the courts didnt allow me to use my corporation as a way not to pay and allowed the trades to go after us personally. This is not true. All of these cases where this money was due we accepted as owing and therefore did not fight any of them when they registered our names personally. We allowed them to get this leverage on us as we owed them the money. Again all have been paid back but a few and we have our reasons for this. All this can be proven as we didnt fight against any of the trades we owed money to, that would be on record as well. Is that someone who is trying to screw the trade. If that was the case I would have fought not to have our personal names on the filings and then let the corporation veil work in my favour. 

Then the 1 million case from 11 years ago. That is actually the insurance company file against everyone they can. This was not a foundation issue, it was a landscape issue that caused issue with the foundation. We were not hired for the landscaping and it was done by the home owner. We passed all inspection for this home 11 years ago. The home owner we sold to actually sold the house to someone else. The home owner we sold to did extensive landscaping and grade changes as well as a porch addition etc. So once again you have only half the story. We never had one complaint from the home owner we built for and sold to. The home owner that bought off of the home owner we sold to made some changes and I have been included in the filing. It is well past the time frame that I can be involved in this since we havent done any work on the home in 11 years or more. 

You talk about integrity. How about a home owner that asks you what work is being done on the 22nd of December and then lets you go without notice on the 28th of Decemebr during the Christmas holidays. That same home owner forgets to mention that I had told them weeks before that we needed to sit down and talk as I could not work under the conditions that he was doing. That meeting never happened. That home owner never contacted me for any issues that he speaks about and never addressed them prior to his terminating the contract. But is quick to talk about work that was done incorrectly. By inspectors that the best they could come up with iin their report was "appears to be" This home owner changed the basement walk up, basement window locations, the living room and dining room set up including the removal of a bearing wall. They moved a portion of a front dormer on the second floor out over the first floor, changed second floor dormers from cottage roof to gable roof framing. They modified many wondow sizes. They replaced 6 foot french doors off the back to 12 foot folding doors. They changed a two single car garage doors to a single garage door. Then they changed almost all of the interior wall framing and complained that the work done was not done as per the permit drawing and that new engineering was required after I was terminated. 

Also I see you comment on the raid on your place but not on the dozens of complaints against you. Mine stem from these two clients that I worked with over the last few years. We have filed against them for $200,000 in oustanding funds. Lets let the courts decide if that is owed or not. Courts deal with contracts, not like Tarion who takes the homeowners word as facts. I will prove the tarion ruling missed facts because the home owner twisted emails and they didnt refer to the actual contract. When Tarion admits that the case is too involved for them to argue in a appeal you have to wonder how they came up with their decision in the first place. 

Then you talk about outstanding payment due to the city, which were all charged due to the one client that owes the hold back money and draw money for work completed that terminated the contract over the holidays and was able to stick all the stopwork order and cease work orders on me. Even though he aknowledge in several emails that he wanted to work through these and start without permit. So instead of saying dont work without permit, which then I would have stopped, I got emails that said he would be homeless and that we had to finish the house and why are guys not working, fully aware that it would mean breaking the law. So left me with the fines even though he knew they would come out of teh projects funds that I never recieved as I was terminated. This guy has so much integrity.

Update: Tarion Appeal DENIED for Steve and Joanna Greer

That raid was a big mistake and came up with nothing – but you fail to mention that.  And it’s irrelevant to what you’ve been doing to people.

Well listen, I’ll save you the trouble of updating the readers. Our source has notified us that the Greers’ appeal has been DENIED by Tarion.  So awful is the evidence of widespread deficiencies and fraud that Tarion won’t even consider their appeal. 

Steve and Joanna are not builders in good standing as they are on record as having at least 3 recent failure-to-enroll homes (which is illegal), 2 recent full damage award claims to separate family victims (detailing fraudulent billing, serious deficiencies in building, and negligence), and Tarion is now investigating their overall behaviour to consider revoking their license to build and sell homes.  So if anyone’s having work done by them… including investigation fees/costs they now probably owe nearly another $100,000 to Tarion, on top of many other judgements, convictions and fines from the Ontario courts/Tarion that have accrued over the last few years, most of it outstanding as of June 2018.  If you give Steve or Joanna any money for future work…well, good luck.  And if they lose their license it will mean it is illegal for them to build and sell homes – perpetrators have actually gone to jail for doing that in the past - concerns for public safety being the reason.

Steve said: “I have made the decision not to work for clients at the level of homes I build.” I had to steady myself after reading that one.  Please let it be true - clients will be jumping for joy if it is.  Hopefully Tarion releases those reports– from what I’ve heard the ‘level of homes’ the Greers build is around what a 5th grader could pull off.  Utter incompetence and negligence at every level, lacking even an elementary knowledge or understanding of the sequence of trade work.  A complete lack of respect for the safety of the home, a disregard for city inspection requirements, serious structural and framing deficiencies that you would almost have to intentionally screw up, non-conforming plumbing/truss/roof/electrical/foundation/drainage work, and work that is not to Building Code.  One recent house ended up too low, another too high, interior stair configurations that don’t even make physical sense.  He can’t follow a basic design.  Then throw in ripping off trades, which led to several clients getting sued for money they already paid (how nice for his clients to get sued by his trades!), liens put on their home, fraudulent billing practices, and illegally almost never enrolling homes in Tarion.. I would say you’ve got a ‘level of home’ builder package that is tough to compete with! The truth is you probably can’t get another job because you wouldn’t have a single positive reference, or a single positive outcome in the last 5 years to sell to someone.  I have no doubt you’re driving people around to houses you got fired from (which is almost all of them), claiming you built them – word is getting around very quickly that you’re a complete disaster artist.  Is there a reputable trade who would do work for you? Seriously, Greer can you come up with a single client who will give you a good reference for your ‘building abilities’ as pertains your work in the last 5 or 6 years. You claim to be such a high level builder – there must be a nice list of people who can vouch for you.  I guess none of the 5 families that fired you in that period?  I guess not the war veterans you screwed?  Anyone else?  Well, produce a single, unbiased, one.  I’m not saying you can’t but I doubt it and we’d all love to see a single legitimate person, who had you build more than a shelving unit, actually speak highly of your work and practices.

As for the inspection that Steve called a joke?  The inspector said the job Greer did was so awful that he’d be happy to stand in court and help put Steve out of business.  I hope he gets his chance.  That’s no joke.  Anyone can call him at the number provided in the last response. 

As for Rock - so the foundation guy didn’t deserve to get paid you say? And you say you’ve paid all the trades that deserved it?  Based on virtually ALL the court, city and Tarion case outcomes the courts seem to disagree with your idea of justice - hence the many judgements and asset seizure and wage garnishment orders against you and your wife.  Your BS only goes so far and luckily the courts and Tarion see through it.  Apparently you don’t think clients deserve their money either - you didn’t pay Rock but you kept the money without giving it back to the client (who paid you for the work up front).  What a perverse sense of justice you have – the trade doesn’t ‘deserve’ it but you get to keep it – perfect! So you’re ripping off the trade AND the client.  That ripoff is part of the reason Tarion ruled against you in that damage claim case too - are you appealing that one?  Good luck.  

Virtually all of what you say is BS and backed up by nothing - lies and manipulation of the truth.  Irrelevant claims and emails from who knows who, which are likely fabricated.`  All those listed cases in which you got sued do not go back 25 years as you state.  100% of them are from the last 13 years and 90% of them, and certainly ALL of the ones that earned you court ordered writs for asset seizures and wage garnishment, are from the last 5 years.  So your theft has only increased more recently.  Of course you would make it sound like over 25 years of ‘building’ you’ve had a few disagreements.  What you call disagreements the courts call fraud and refusal to pay what you owe, and they issued asset seizure orders as a result – that’s not a ‘disagreement’, that’s theft plain and simple.  Even after rulings that you owe money you still didn’t pay most of the trades and suppliers or the court ordered building act fines – what a stand-up guy you are.  But you sure can manipulate the truth, it’s your strength (building certainly isn’t).  And just imagine the trades that never filed claims against you – we counted 8 of them that you ripped off on only 2 of your projects.  They just didn’t have the time and money to go after you, and given the legal system we have I don’t blame them.  It’s quite possible that at some point you could competently screw in a light bulb - although based on the current $1 million civil suit against you for shoddy foundation work from the mid-2000s I would say your negligence and incompetence goes back many years (case CV16005515380000).  It’s also possible that you did some good for the Legion at some point too, but that doesn’t discount your recent fraud.  The President (in the audio) and a few other members have said you haven’t set foot in there since you ripped them off – is that evidence that you’ve done nothing wrong? In the real world you don’t get to say that doing something nice 10 years ago absolves you from screwing tons of people now.  You’re a crook and have been for years, own it.  It’s all coming out. 

You “making a few mistakes” is putting it lightly.  It’s quite possible that you got into money trouble.  You had to sell your home to someone in 2014 but continued to live in it for almost 2 years.  The likelihood is money problems that have sadly led to so much suffering for victims in the last 5 years.  A person’s integrity says a lot about their character.  You're free to argue that the sky isn’t blue but the evidence is overwhelming.  What else can anyone say at this point.  Piles of factual evidence displaying systematic defrauding of clients and trades.  Even an audio call from the President of the war veterans Legion talking about how you ripped them off (not just some member, the PRESIDENT). Brock Landscaping must be the trade.

So I did a little more digging. And as the trade who says he was ripped off by me I figured out who. As there are not MANY it was pretty simple to trace it back. Brock from Brock Landscaping, you can find his website here https://www.brockslandscape.ca/ was one of the trades I did not pay approximately 2 to 3000 dollars to. He did some additional grading outside the scope of work I hired him for that the home owner asked him to do. When he asked the home owner to pay the home owner said it was my responsibilit. But it was clearly a extra. So when the home owner would not pay Brock he said I owed it to him. I disagreed and he has been hounding me for this payment ever since.  But what also should be known is Brock on that same job made a error on the interlock walkway that had to be rectified that the home owner had to pay for. His machines did damage to the street in many areas. He has no regard for public sidewalks or roads. His game is price you really low, get the work and then get you on extra's. Don't believe me on this here are a bunch of reviews that his clients have listed on Yelp, home stars, yellow pages just to name a few. And here they are for your reading pleasure;

they were a bunch of kids that did not know what they were doing. when I called back on many occasions to get them to come back I was totally ignored and they do not return calls.

Landscape Contractors & Designers review in Oakville

He was rude after our initial interview. He/crew was late everyday and the material sat on my curb for 3 weeks. When i asked to replace that grass, he said it wasnt in the deal and said just use grass seeds and water. The quality of work was okay. But he just handles the operation poorly. 
Not recommended.

 

 Although the price is good, the customer service SUCKS! Brock doesn't ever apologize or even sound apologetic about anything! He cops attitude and that, to me, is poor customer service.   0/10 Landscaping Landscape Contractors & Designers review in Mississauga Over 3 years ago

I had a horrible experience with this company. They only did half the work they quoted on, were extremely rude, unprofessional, the workers don't care about peoples property, they quality of their work was terrible and they caused a lot of damage to my property. I would never use them again and I will tell everyone I know about how bad my experience was.

Not happy with this guys at all. Use at your own risk and with my warning. Very unprofessional from beginning to end. They mostly use young in-experienced guys who like to make things difficult , argue and fight with neighbours and customers. Rough job , killled off nearby vegetation and made a real mess , still cleaning up here. This is my experience .

We needed a good contractor to help us in leveling, sodding and installing a dry well after our above the ground pool was removed. Happy to find Broke, (Sep 2013) 
and agreed on the job, we proceeded with the project. Unfortunately, the result was not great at all. The dry well ended up as a little pond after the very first rain. When he followed up, he insisted the job was good (practically done by 2 young men). Contacted again and asked to come and fix it, he did actually hung up on my call.… read more

I have never in all my years of doing business with companies have I come across a company who is represented with the most unprofessional representation. The manner in which they do business is appaling and disgusting.  After doing business with this company and needing documents pertaining to our job the man or owner was downright rude and told me "I'm Fired" and hung up the phone on me just because I was inquiring for a copy of our invoice.  Told me he doesn't  know where it is and why don't you have it?? (Rudely) I reply well that's a rude way to talk , then he immediately replies "your fired" and hangs up. This is the appreciation you give to customers who put their hard earned dollars in your pocket and this is the respect and appreciation you show???? Shame on you... Disgusting and I hope no one ever uses Brock for any of their services you are not worthy or derserving of peoples business.

i am not claiming to be perfect over the last 25 years and I will admit I have had issues with trades in the past where money was due. Some because work was not done the way myself or clients expected and some where funds were held back by clients. But I have paid all the trades that deserve to be paid. Only ones that have not I have a dispute with. Conviction for starting without a permit, yes I have many but not one of the homes I started without a permit did not get occupancy. You have to have a great deal of knowledge about construction to try and build without a permit. Tarion charges none as of yet. None in the past. Still have appeals  to deal with but will post those results myself when they have been completed.  

 

The home owner Hans Albrecht terminated our contract over the Christmas Holidays and we have filed in court for $200,000 in funds owed at the time of termination. Plus 1 million for slander. 

 

Also to be clear the person who  phoned the legion disguised there voice in the recording and said they were a potential client that name was Jeff. This is untrue as I don't quote clients at this time or have any clients at this time that are not investors. I have made the decision not to work for clients at the level of homes I build. 

 

So i I will continue to update everyone who reads these posts with my situation and of course Hans and Brock's

So you respond to my response and still dont give your company name or what trade you were. The list of trades I owe money is a very short one. I dont deny the court cases from some trades as in my industry this happens. I can also tell you I didnt fight pretty much any of them as I knew the money was owed to them. You think home owners never stiff their builder. It happens basically every time. I have paid any of the trades that were ligitimately owed money. That can also be confirmed. You mention Rock concrete but what you fail to add is that after they finished their work several cracks developed in the foundation. Not just 1 or 2 but about a dozen. They were asked to review this and rectify them over a 6 month period and never did. There were engineering repair reports. There was a concrete scan done that showed that they never installed any of the rebar that was on the plan. Is that some one who should be paid. Would not just about anyone have issue with that. You say Tarion is pro builder, now that is a joke. The entire industry knows they are there for the home owner. Home owners can just about say anything in their reports without Tarion even visiting the site. The one house in question was completed before the home owner filed for finacial recovery. They made several errors in there report and hence our appeal. Tarion almost always denies appeals and I have not been denied at this point. If they allow the appeal it is because you have pointed out to them flaws in their report. You dont even see half the files that the home owner submits. They say back walk up was $47000 plus. But dont supply the quote to the builder for review. The back walk up could not be $47000, the whole foundation was less than $50,000. They say the stucco had to be removed because it was installed not to code, but dont supply a legitimate report of this. They take the home owners word.  

Oh and Jays reports, lol. Just about everythings says "appears" to be installed incorecctly. The report was done after I was termiinated. On items that were incomplete. What a joke. 

 

Then there is the Legion. I have sent a email out to Jim C. I have told him he was recorded, which I am sure he was not aware of. Jim and I dont see eye to eye and I have attached here a comment from the president of the Legion when I was doing work for them. I did not stiff them. I just didnt complete the work, which I was donating my time like I have done many times over the 11 years I was a member. Here is a email about me from the President:

This email was a responce to my concern that I had heard Jim C. had said a few things about me that I felt were not right. Jim was CC'd on this email. I will not let the comments of one person tarnish 11 years of hard work and donations. I have installed powered beds in seniors homes that we had donated. I have picked up wheel chairs and walkers that one of the members refurbished for people who could not afford them. I was asked to be the Host when the previous Legion President was retiring. I hosted Lets make a deal for the seniors from the old age home down the street. I donated lumber for the deck. Fencing for events. I raised money for the Hospice. We did talent shows to raise money. I delivered the Christmas gifts in my truck to the local church. The list goes on and on.    All thes court cases that you talk about mostly are for starting without permit. I do this for the client. I take all the heat and the client walks away without any issue. If the home owner does not want me to build without the permit they just say dont. But they never do. So yes I am guilty of this as well. But try dealing with a building department that takes over a year to get you a permit. I have about 8 or so charges against just for this. Most of the rest this "trade" talks about are spread over 25 years.    So lets keep this going Hans, I mean Trade guy.

It’s understandable that Steve has trouble remembering which trade I am since he’s stiffed so many of them – it must be hard to keep track.  But true to form for someone who constantly distorts the truth, he picks and chooses what he’d like to address and ignores the most damning evidence. 

I’m not sure about some of the specifics of the Tarion Warranty Corporation and client court case Steve refers to but I do know that Tarion is a very pro-builder organisation.  For them to rule against Steve and Joanna is no small feat.  These rulings follow 18 month investigations – Tarion turns away 80% of cases brought to them.  Only the clear ones are allocated resources by Tarion, and even fewer result in favourable rulings to the client.  These rulings result in Tarion paying out $$ to these clients therefore they are exceptionally thorough.  Not to mention there was a SECOND Tarion ruling recently for maximum allowable damage claims against Steve and Joanna Greer payable to yet a different family.   I guess they got that one wrong too Steve?

Naturally it’s all a ‘misunderstanding’ according to Steve:  2 negative Tarion damage rulings, several other previous Tarion convictions/fines, a dozen city and Ontario Court charges and judgements for a variety of supplier-stiffing and Building Act violations, 20+ court claims brought against him resulting in many judgements against him/his wife and Harvis, around 6 of which have resulted in Notices of Garnishment and Writs for Asset Seizures against Steve/Joanna Greer and Harvis Barklay.  Even his fellow defendants have sued him in counterclaims for having been dragged into his world of fraud and deceit (case CV15005239860000).   The reader can find cases in Superior Court and SC databases – there are dozens: no misunderstanding there.

Call J for the truth about the horrors that Steve perpetrated on jobs that J had the displeasure of inspecting after Steve was fired.  J's business is to produce third party court-admissible damage reports in situations like this - he asseses negligent work. 647-889-4357.   Call John DaSilva at Rock Concrete, a foundation company, and ask him about how Steve stiffed him for over 40K. 647-229-2464.  Steve simply decided not to pay him (a great way to boost profit margins on projects).  The list goes on..  This kind of thing has happened too many times with Greer it and shows a record of systemic and premeditated fraud in screwing company after company, client after client.

Sorry Steve, you don’t need much help in ruining your 'reputation' – you’ve done just fine yourself.  I know I’ll never see the money you stole from my company - if it weren’t for such a lopsided legal system you would have been in jail long ago.  But people just have it all wrong?  Well, sadly they don’t.   Like Jim at the jilted Legion said: “(Steve) talks a good game, put it that way”.  But it’s all catching up to you.  I’m sure you sleep well at night in your nice home paid for with theft.  Some people decide to cheat and steal their way through life.  Some people don’t.   Lessons learned.

Caller: So I just want to kind of, you know, check, do my little uh due diligence and make sure..

Jim:  Yeah seriously, we’re a Legion, we’re not-for-profit and yeah he stiffed us big time….and actually there’s others that I’ve heard as well

 

Caller: I’m sorry, what was that?

Caller: Oh, so did he try to do some work and he just didn’t do it?

 

Jim:  Well yeah we had it all set up, uh, money was given for materials, this that and uh, what happened with the work?

 

Caller: Wow..

 

Jim:  And yeah it went on and on and on and we even went and approached our lawyers and the lawyer said don’t even bother fighting it, because it’ll just be appealed and appealed and end up costing us more in lawyer fees than the money we lost.

Jim:  We lost about 12 grand, 14 grand

 

Caller: Wow, well that’s good to know. I’m sorry that happened to you but, um, somebody said they’d heard something strange happened and I just wanted to maybe..

 

Jim:  Oh yeah. And he was a member here too, believe it or not

 

Caller: Well that’s what I’d heard, that he used to come and volunteer and do things like that

 

Jim:  Yup, yup and that’s it, and actually since that time we’ve never seen him… well we’ve seen him the odd time on Lakeshore here and there walking around, but..

 

Caller: Right but he doesn’t do any sort of volunteering or anything like that

 

Jim:  He doesn’t even set foot in our branch

 

Caller: I can understand why now

 

Jim:  People would strangle him

 

Caller: Yeah oh my goodness I’m so sorry to hear that, especially with our veterans, I mean..

 

Jim:  Yeah, exactly..

 

Caller: …It’s unconscionable

 

Jim:  That’s exactly what we’re here for, for our vets, and the community and to have somebody in our community do that to us...  you know what I mean?

 

Caller: Ugh, I just, I just feel for you, that’s something else, boy I hope that never happens again, what a jerk

 

Jim:  Well now we started doing our due diligence with everything, he was a member here, and honest going and this and that, we shouldn’t have a problem…(Jim clearly didn’t know his legal history)

 

Caller: Yeah, you know one thing guys like that have going for them is that they seems nice

We have a pending court filing against individual named in this rebuttal hence the without prejudice.

I am the owner of Harvis Barklay, Steve Greer. This report has surfaced in emails to others. When I responded to the email about sitting down with this trade I did not get a repsonce. I told the trade, that he does not mention his name or company in this complaint, that I would be happy to clear things up with them and to just get in touch with me.

They never got in touch with me, they just keep posting this message. The other trades listed go back over 18 years and on the list Lee Rocca Forming, Homebridge, Pollard Windows, Zetta demolition are all paid up in full. I have been buidling for 25 years. In that 25 years you will have issues with trades over quality of work or final payments due. The list posted is less than dozen of trades mentioned. My projects in the last 25 years have been liened 2 maybe 3 times and settled right away. Most of these resulted from clients holding back funds much longer than they should. Try being a builder and not ever having any issues with trades or clients. Then try staying in the same neighbourhood for 19 years and live amonst your clients. Not easy to do if all this about me was true.

The information in this complaint is priviliged information to a client I had that I have a lawsuit against named Hans Albrecht. We are presently suing him and his wife for $200,000 in unpaid draws and work completed. We posted a lien on their home. Also 1 Million for slander against us. He hides his name. unlike myself, in every email he sends out, everything he posts and every call he makes. He never lets himself be known. I myself am respoding to this with my full name and company name. Anyone reading the report against myself and my company should ask yourself why the trade that wrote it mentions all the other trades but not themselves. The courts judgements of $250,000 mentioned go back 18 years. Of which about $200,000 of them have been paid. The court actions mention recently in the amounts of 2 million are because this same person Hans Albrecht, filed a fraud case against me. He has a case for $750,000 againt myself, my wife and one other person I wont mention. Thats $750,000 against 3 people. Nothing else but fraud and a few construction items that he claimed to be installed incorrectly.

The fraud case is fabricated to do damage against me and my company and my wife has been drawn into it for tactical reasons. Hans Albrecht originally filed in small claims for just $25000 but when he found out we were suing for $200,000 he decided to pull the small claims case and file the fraud case, seems strange. This person is a very vindictive human being. He breached our contract without a days notice with $200,000 owing and over the Christmas holidays. He hired another builder to complete the home and financially made out like a bandit at my expence.

His filing in Tarion is full of lies that he was not asked to back up including false statements on payments made for items I did not complete under contract. That payment for electrical and plumbing rough in for $40,000 was paid that was not. That I agreed to complete work for a $85,000 draw that the payment should have covered the completion of this work when it was clear this was a payment made to do this work with funds coming in further draws. He decieved Tarion in his filings and we have filed an appeal now that we have been able to review his case papers. Home owners have the upper hand with Tarion but in the appeal process it is thrid party and eveidence and contracts is what matters. I have no charges listed on Tarion site at this time and I believe I will be successful with my appeal. 

I dont hide from anyone. My builders sign hs been on the sites in the area for over 18 years. I live in the area and can be reached at anytime by any trade or client. There are always two sides to every story and in this case this one individual does not want to pay what he owes and is using these sites as a tactical move. I will continue to monitor their lies and wait for the "trade" that posted this to identify themselves so I can either clear up the issue they say they have with me or fix any issues they have with me. To the trade that posted these claims against me, post your information and what specifically was done to you so readers can believe this article and I can settle up with you. To the readers, if you hear from this trade please let me know so I can clear things up with them.
