In February of this year Mr Rick Hard, owner of Stone Oak Lawn Association and I entered into a verbal agreement to have some work done on my home. We agreed that $700 was more than substantial to complete the work and any additional money would be used to plant flowers around my property. Mr Hard was to begin the work immediately, but said he would have to work it in on weekends. I agreed to that condition. After several weeks, no real work had been done at the home. I spoke to Mr Hard on the phone and he explained he had been sick and he would begin and complete the work in a few days. After about another week, there was no visible work done in my yard. I contacted Mr hard again and told him that I wanted to get somebody else to do the work that it was taking too much time for him to even get started. I knew that he had purchased some of the materials and offered to take possession of the materials along with the appropriate receipts and deduct the cost from the money I had paid him. He responded that he would need to collect the receipts and he would send me the receipts and a refund check in the mail within a few days. When he finally sent me the receipt for supplies, he had also invoiced me and tried to charge me $200 for labor that did not happen. I contacted him again and told him that I only agreed to pay for the materials and I would not pay for labor tht did not happen. He told me I would be lucky to receive anything at all becasue his time is valuable. However since his valuable time was not spent on the service that I hired him for that statment has no bearing on me. He has said he will return $115 to me and my family. I have been scammed and essentially paid $585 to get my lawn cut and have a minimal amount of supplies dumped in my back yard. I told Mr hard on phone messages that I would be willing to accept half my money back. even though none of the work was done. He told me that he doesn't owe me anything and I am lucky to get the $115 dollars back because his time is valuable. I have been scammed by Mr Hard and Stone Oak lawn Association.

Why you should NOT lie.

AUTHOR: Rick Hard - (U.S.A.)

Ripoff Report is a way to basically voice your bad experience with a contractor who you may feel has done you wrong. Unfortunately there is no way one can determine whether the information is true or not. First make sure that you are doing business with a reputable company who has been in business for at least five years & that can back that up with current and longtime references. A job isn't any good if it only last half the time it should. In landscaping, the contractor should be able to prove mature bedding projects as well as recent and on-going designs, they should as well be able to back the designs with pictures and telephone numbers in which you can call.

If you are dealing however, with a so-called friend, and decide that you are no longer happy with them, don't go and lie on them in a malicious and vindictive way and try to ruin thier business just because you didn't get your way. When you make a deal with a contractor you get a contract outlining everything to be completed for an agreed price with signatures from both parties. Then if anything goes indifferently you have some thing in writing to fall back on. The people in this case however did not have a contract because they were dealing with someone who they called a friend and not a contractor. If they would have had the finances to get the work in which they wanted done then again it would have been different.

I was in this project to help out somebody who was pretending to be friends or I would have never gotten started knowing what I did up front. They told me in advance that they couldn't afford the work because they had just bought the house. But they promised more work than I could handle with they're contacts, which is the way that we met to begin with. I was hired by the company in which she works for to install the Christmas lights on the Base Commander's Housing at Randolph Air Force Base here in San Antonio, a job that we had only compliments on. With all the promises of extra work on this and other area bases from her and her husband I was willing to overlook thier financial shortfalls on the work which they needed on thier own home. They never once told me however that if everything wasn't to their liking they would be so vindictive and lie on me.

The proof is in thier own writings and stories in which believe me they have told anyone who would listen or read. The title of their first letter on this web page, " landscaper took the money refusing refund or doing any work" the second to last sentence in first writting contradicts exactly this. If there was no refund offered then where did they come up with the $115.00 from ? The job had been started and was only a short tme away from being finished. The materials had been stragicly placed where the work was to be done instead of as she told the B.B.B. "dumpped in thier back yard". Why would I go and throw the material in thier yard when I would have to move them later to mow?

Second they lied about the total on the project, $700.00 instead of the correct $1200.00 to $1500.00 depending on the tree or plant in which we would use as a center piece for the dog-run and the type of fencing to be used. Until all of the materials were agreed upon, there's no way in which to put a total price on a job. In addition to all this was the lie about having the work we had talked about done by some one else which could of been our job. I wouldn't do the job in which they had done because it looks like exactly what it is, a job that they couldn't afford to begin with, unless the company comes back to finish the flowerbed it looks like the money ran out about half yard.

On one side of the yard they have a stone wall surrounding part of the bed, where the dollar or rock , which ever came first , ran out , they installed metal edging. The job which we had originally spoke of would have had rock across the entire lenth of the front and would have at least looked finnished instead of half-done and the beds would at least have plants in them thats why they call them flowerbeds.

Last but not least, if you are going to hold someone's tools and not return them then you may be criminally filed upon with theft as this couple has. Bottom line is that if you feel that you have been wronged or cheated out of money by a contractor or friend then try to work it out with them first instead of doing as they have. The court has something they call jail for thieves and if you are doing wrong then you deserve what you get. Make sure to state the true facts in the case instead of lies and you will have a story to tell the Judge and get your money back. NEVER tell lies and you wont have anyone take your statements apart and prove that you have indeed lied. I try to please everyone in which I have worked with alot of times giving extra to ensure perfection. Being in business for the last 18 years in the landscaping industry has brought me several enjoying times and references that I truly enjoy sharing with others please don't be blind-sided by the lies that these people have posted.

If this were truly charitable, your customer would not be compaining about being out $700. This same charitable case hired another person to come out and do the work in a day. The front yard has been contracted...and paid for in CASH- that would have been your cash had you done the simple dog run as promised to begin with. The idea was only an idea as it was never started... the time was non existant. The tape measure and extension cords that were left at the home will be retuned in court, per your recommednation, unless you want to reimburse half the money you accepted for work not done.
No friend would ever do this. I am just trying to make sure nobody else hands over their hard earned money to you, the true Scammer.

How can you say you were scammed when you walked away from this with $700...minus the supplies ypou say you purchased...which still makes you $500 richer.

#5 REBUTTAL Owner of company

Scammed by so called "friend"

AUTHOR: Rick Hard - (U.S.A.)

POSTED: Monday, May 12, 2008

I am the owner of Stone Oak Lawn Association. I appreciate this opportunity to rebut that which I have been accused.
After reading over the complaint left by bobcat, I immediately found several discrepancies to our verbal agreement.
After hearing of the idea she had for a dog run, I began to share some ideas for its design. She asked if I was capable of completing such a project and if I would be willing to do so for her. I agreed with the understanding that I have a routine client base whose needs I must attend to as well as several projects ahead of hers. I in no way implied that I could begin work on her project immediately.

She in turn replied that she completely understood, and still wanted for me to do the work, and was in no certain hurry as she was still trying to come up with the finances. The $700.00 was to be a down payment toward the dog run area, ie. dog- shelter, fence, plants to cover fence posts of existing fence and a larger plant or small tree for the center of this area as it was in direct view of dinning room and was in NO WAY a total for this project . The estimate was $1200.00 - $1500.00, depending on what plants or tree and what type of fencing, I was going to use.

I proceeded to design the fence and purchase the necessary supplies. I will add that I strategically placed them on the side of the house where the dog shelter was to be built. There was even a two week delay after I left the material at her house as I was awaiting approval on style/color of materials from her. She stated that she was out of town and her husband was to busy with his schedule for this delay. Although she agreed that weekends would be suitable to work, I felt compelled to cut out early on one occasion whereas she was entertaining friends. After a couple of weeks had lapsed as I was working on more pressing projects, she contacted me and said she wanted to find someone else to complete the work for which I had designed, piloted, and basically left my idea as a kit for another to come along and complete .

For the record, there was less than a half hour left on the dog shelter and an hour on the fence. I find it disturbing that I had been referred to as a friend, even being offered cocktails during a visit to discuss plans, and now I am considered a scamming contractor. I never once asked for any compensation for hours of consultation on everything from landscaping to deck design as I thought we were building upon a friendship as well, and I do not find it to be a bit nerving to request my personal tools for which I use regularly. I won't even get into the cost of a good 6 foot aluminum contractor grade level.

What really gets to me is that she actually agreed to return my tools, agreed to the refund amount and up until reading this report, I was awaiting a response from her as to when she would be able to leave MY things on HER front porch at HER convenience and I would make another trip to leave her a check and original receipts for the materials as SHE requested. Needless to say, I have yet to hear from her.
I have since realized that I should have never taken her on as a lawn care client as she is not in my usual area, but in an attempt to see the progress of her landscape as well as a friendship, I obliged.

I'm the one that was SCAMMED, for my time, ideas and friendship by some one who wasn't worthy and now she wants to defame my character by telling untruths and posting them online. I've been in this business for 18 years and have learned that you can't please everyone no matter how hard you try and how much of your time you give , but those who I do and have pleased out number the one's that I don't by multitudes as I struggle to achieve perfection in all I do.

Even though Mr Hard said he would provide a partial refund no money has been returned. He aso had the nerve to ask me to return his tape measure and extention cords...which are part of the supplies he left on my property.
