I have a problem regarding my Homeowner's Association and their policy of assessing fees.
I live in Cottonwood section of Sun Lakes and we were notified last year that each family would be assessed $1,400 for renovations of our area. A form was sent requesting that we indicate how we wanted to pay this special assessment. My husband and I decided not to pay the whole amount but to opt for a monthly payment. I wanted to send the first payment in February, but could find no info on the date of the first payment. I called the office and was told by the accounting department that I was late with my payment. I disagreed because I thought the first payment was in March and it was now about the middle of February. I was informed at that time that the office had no response from our home about how we wanted to pay this assessment. I argued that my husband had delivered the form and had put it in their mailbox, since the office was closed. The woman on the other end stated that they had nothing from us and that we would have to pay a $20 late charge. I became angry at her attitude about this matter without any consideration when we knew we had sent the form back. I then told her to forget it and I would pay the entire assessment. My husband took a check over to the office to pay the entire amount. He was then told that we would have to pay a late fee of 10% or $140, even though the entire amount was paid.
I think that the people there are very mean-spirited and have far too much power and are totally not accommodating. Why should I pay a late fee when I'm paying the entire amount, especially 10% of the entire amount! Also, I was less than a month or so late, and since I was paying the full amount, why could I not get a break -- they got their money! I get more consideration for my lapses from my creditors. I have never been late for my HOA dues, in fact, they are sometimes paid up for the whole year or in bi-weekly payments. I understand the purpose of late fees to encourage a steady flow of income for their purposes; however, what they are proposing to me is just a punishment because the lady did not like my conversation. Who gives these people so much power over seniors, who are prone to lapses. I think a little consideration is in order.
I called the office back to discuss this matter and the woman told me that I had to pay $140 and there would be no more discussion on the matter. I guess she thinks she speaking to a child and I feel helpless.
I contacted Nancy Peannebecker, the President of the Homeowner's Association for Cottonwood, twice and left a message. She never responded to my calls, which is not surprising since I have never had good experience with the Board since my car was stolen twice in 1 month after moving here.
I then contact the office manager (whose name I do not know) and explained this situation to him. He acted interested and said he would look into this problem; however, it has been at least 3 weeks and I have not heard anything from him.
Is there any help or direction (outside of legal action) you can offer so that I can get some relief from this problem. I would appreciate any help I can get, as I don't know where to turn. I think they are taking unfair advantage in assessing such a high amount after the total amount is fully paid.

I somewhat disagree with this property management company employee, and especially insofar as her representations about "priority of payment," as that differs many times under state law, not merely in what she refers to as "your governing documents." Also, in many documents the Board and property management company are not given unilateral power to raise any fees, or collect junk fees at all without consent or votes of the membership. Many of the older communities were not meant to be dictatorships, but there at the will and accountability of the members and membership.
That said, I agree about buying into one. It is corporate socialistic land use, not ownership in the slightest. I wonder what Ben and Tom would think about HOAs, with your neighbor given the power to seize your land for not paying arbitrarily leveraged assessments, or if your neighbor didn't like the shade of your paint. This is socialism, and hardly what the founder's intended for land and property ownership. They aren't apartments either, where the property management company was intended to have a great deal of power over the owners of these properties since the only real land ownership or control primarily the Association was intended to have was over strictly the common areas, the "corporately" owned properties.
It has been the lobbying of property management companies, collection and foreclosure lawyers, insurance companies, banks, etc., etc., that have changed these "associations" into money pits for the owners of these properties, and cash cows for those industries.
Move. Move now, even with the market as it is. They just "assessed" and "taxed" you over $1,400 without your vote or consent - and for what?

I work in property management. If your special assessment was late, you can and will be charged a late fee. The amount of the late fee (in your instance, it appears to be a percentage of the over due amount) is set up by the Board of Directors. This will be in your governing documents, which you should have gotten when you bought into the Homeowners Association. (These would have been provided to you by your realtor or escrow company. It is not the Homeowners Association's responsibilty to provide you with these documents) It is up to you to know what is in these documents. Most associations have a "Priority of Payment" which means that the next time you make payment they first pull out for fines and late fees, anything left is then applied to the special assessment and THEN maintenance fees. So if you don't pay your fine, but continue to pay your maintenance fees, the fine will come out of your next payment, and THEN your maintenance fee, leaving you short and incurring further late fees.
Since you were (by your own admission) late in payment, the circumstances are moot. You agreed to pay all maintenance fees and special assessments when you bought in. The Homeowners Association had set up the late fees. You don't have any recourse at all. If youu refuse to pay, they will continue to pile on late fees and you WILL get a lien put on your home and lose it. i see it happen EVERY SINGLE DAY.
As the girl who talks to people regarding late fees everyday, I will give a word of advice. Be nice. It goes a long freaking way. If someone calls and make a understandable error, I will waive their fees. If someone calls up, and tries to be antagonistic or rude, I'll be damned if I waive them.
That being said, I would personally never, ever, ever buy into a homeowners association. ever.
