My son purchased a Ezip Trailz (UPC A69402714081) Serial # 6940 2714081 on 15 May 2009 at the Walmart store 2751 in Englewood, Colorado.


On 17 May 2009, he was riding this bike to work and drove off a low curb. This caused the front wheel to collapse and sent my son to the ground. In this mishap, my son scraped his hands, knees, and a scraped chin. In addition he also sprained his wrist. We had no injury claims.


On 18 May 2009, my son and my wife went to the Walmart store in Englewood, Colorado and asked for the money back and returned the bike. The local Manager of the Walmart did not issue a refund but gave them a phone number (1-800-527-0556) of CMI and assigned a claim number to it (L9777466). Throughout the last year my son repeatedly called that number, left message after message, and never got a reply nor did anyone ever answer the phone.


Since March 2010, I got involved in this process and also found out that Walmart is not very responsive. I had numerous emails and phone calls to Walmart that remained unanswered just like the calls to CMI. The only time Walmart is responsive is when they miss the point and think we are looking for a product.  Once I explain the situation, silence will follow.


Since May 10, 2010 I have been calling CMI who's operator told me that a person named Cricket is assigned to this case and the extension is 20566.  I called about every hour and nobody answers the phone.  I find this strategy of Walmart very unethical and questionable!

People will look anywhere for a conspiracy, won't they?


Karl,


Companies have been taking out life insurance policies on their employees for decades. When an employee dies, the company loses money from lost productivity and needs to spend more money training an employee to replace the deceased one.


This is not new information.


My dad remembers Kroger's taking out a policy out on him in 1961. So, you're a bit behind the times. There is no conspiracy, so your post is dumb.

It is always funnier if it is not your kid.  Nope, generally we do not video tape our son when he goes to work every day. 

How about you?  Go and buy a bike at Walmart and have someone video tape every trip you take.  I am sure within a couple of weeks you fall and then you can win some money on AFV.

We received a phone call from a very humble store manager (previously very hostile) Chris Herndon who told us he will send a refund in the full amount.  Guess between the Ripoff Report, News Channel 31 in Denver, and me contacting the Regional Manager we can bring this to an end.

Sue the manufacturer.

Your problem is with the manufacturer of the bicycle, not Walmart (retailer.)

You need to SUE the manufacturer for a defective product and for personal injury to your son. 

A similar thing happened to my step son some years ago.  His mother purchased a mountain bike for him and approximately 2 months later, he rode off a curb and the "yoke" (where the front forks attach to the frame) separated from the rest of the frame.  He was OK except for some scrapes.

My wife ended up sueing the bike maker.  It took almost 2 years to settle the case but my step son received about $4500 for his injuries in addition to a refund of the purchase price and legal fees.  My wife sued on behalf of her minor son.

Walmart is NOT going to get involved.  You should consult with a competent attorney and sue the manufacturer.

May 13, 2010: Received a call from Chris Herndon who is the Manager of Walmart store 2751 in Englewood Colorado (303) 789-7201.  Mr. Herndon seems to think, since CMI "closed the case he does not have to give us our refund! Even though I told him that the CMI report and our refund are two completely different issues he still refuses to give us our money back.

May 12, 2010:  I just received a phone call from Ms. Cricket of CMI (Walmart's Claim Department) who pretty much told me that it no longer their responsibility and I would have to talk to the manufacturer! Nice way of Walmart to get out of this!  First they do not respond to you at all and when you don't give up they just tell you that it is no longer their responsibility!  My son gad bloody hands, knees, and chin but all we actually want is out money back!

12 May 2010: Did research and found a Janet Hall of CMI sent an email to Janett and asked for help. She replied with an email and told me that she forwarded my email to Rodney Jernigan who is Crickets supervisor.

12 May 2010, 01:35 P.M. (CDT) called Rodney Jernigan (Crickets supervisor) and did not reach him. Left a message and am waiting now to get called back.
