Surplus Canada - Daniel St. Amour - Matelas Acces Direct ripoff scammer complete fraud very dishonest Chesterville Ontario

On March 19th 2006 I placed and paid for an order with Surplus canada for $2100 worth of goods to be resold at a fundraiser that I was holding on March.25th 2006. At the time of placing the order I very cleary stated both on the phone and in several emails exactly what I wanted to receive. Surplus canada's owner Daniel told me that i would receive "all current season, name brand items, with tags attached, each piece would have a retail value of at least $35 and that if I wasn't satisfied he would replace them." He told me that I would receive brand
names like Tommy Hilfiger, Gap, Gymboree etc. When the good arrived I was beyond disappointed, they were old, damaged, used, with holes, no tags attached, and none were brand names. I immediately called the plant and the
women I spoke to told me that she was the one who put the package together and she was told just to "put a bunch of baby goods in a box" she then told me that he never told her anything about them being brand names, new, or anything a such. she further said that she has never even seen brand new tommy hilfiger items. I asked her if I would have a hard time getting my good replaced and she said "well I don't know, Daniel is French" I said what is that suppose to mean and she said that French Men are very difficult to deal with.

Anyhow I then spoke to Daniel who said that he would look into the matter, and promised to get back to me. He didn't. I finally reached him again and he was so rude to me, told me that I "got what I paid for". after
sending him pictures of the goods he told me that he would replace them and that he would pick the goods himself. Again I didn't hear from him, a few
more days passed and I called again. This time he said that he had the tracking number at home and that he would call me with it. Again I didn't hear anything. I called again a week later and he said that he had shipped it and that he had confirmation that I received it. I told him that I wanted the tracking number and he said that he would call me back. Again no reply.
I called again, I finally received a tracking number and it was not valid. He told me that he would look into that and call me back. Again he didn't call back. Then today I called again and when I finally got angry with his lies, he told me that he was not going to do anything about it and that I needed to contact Canada Post myself however he said that he would send me a
scanned copy of the document stating that I had received the goods, which he now refuses to do. He also refuses to replace the goods, refund my money, give me the name and address of the women who originally packed my goods up, give me the number for the local police dept, or give me a tracking number.

I do not want to take this to court but may be left with no alternative. If anyone else has a problem with this company and would like to start a class action law suit please email me at (please replace with appropriate symbols, i am putting my address like this to avoid spam)
