I was in a Debt Management program and Suttell & Associates refused to work with them and would not respond to any of my calls nor my faxes. They then began to garnish my wages, during a period where i had a family emergencie i tried to contact them 4 times by phone and several faxes to get them to respond to me to see if the garnishment could be lowered to what i had going on with my new baby and i explained to them the medical only covered 10% and due to treatments she would need i could not afford the 25% garnishment, they never responded so i finally got threw to some one who i could talk with and he did not even want to work with me. Then he said well lets see you get paid Bi-weekly so garnishment is about $355.00 a paycheck and you get paid when, so i told him i get my next check in one week he said if i could come up with $1200.00 then we could work something out.

I stated how could that be possible when i can hardley afford the $350.00 you take out every check, he then said well if you cant come up with it then we wil just proceed with the garnishment. I explained to him that i would like it explained to me how then could garnish 25% of my pay each check by then want $1200 in one week? He said it is not my fault you dont understand and we cannot help you. I just want to know if there is any help out there to make this debt collection company more willing to work with people.

The short answer is no, there is nobody who can help you with your garnishment issue. Garnishments come pursuant to judgments or, in some cases, administrative orders. An attorney sends your employer a garnishment order, the employer determines how much of your income is exempt (pursuant to legal guidelines), and sends the rest to the garnishor who, in most cases, is someone that has a judgment against you. There is no discretion on ANYBODY'S end as to how much is garnished.

I guess that wasn't much of a "short answer," but the long answer is yes. You can put a complete halt to these garnishments by filing bankruptcy. The filing of a bankruptcy petition puts a complete halt on ALL collection activities.

Further, if you were to file Chapter 13, or if you had a Chapter 7 "asset case" (which virtually doesn't exist in Michigan), the court could reduce the amount you owe to this debtor by as much as 20% for their failure to negotiate in good faith to reach a reasonable payment agreement.

So if you are truly strapped, bankruptcy may be the answer and, honestly, it's probably the only answer.
