In August of 2002 I signed a contract with T-Mobile for service. At that time, I was told that service was available in my area. There was no service in my area and no allowing me out of the contract. They continually claimed that service would be available shortly. It never was. The only time we could use our T-Mobile phones was when we went into the city or when my son drove for miles to make a call.

When I signed for the service, T-Mobile put my service in my former married name. They did not put the service in my legal name, which was on my driver's licence and on my credit cards. I tried to cancel service several times but was not able to, due to a huge bill ($400) they would charge if I cancelled. When I signed up for service they told me that it would only cost ($200) if I wanted to cancel. Then when I tried to cancel, they said that because I had signed up for two phones (same service) it would cost twice as much. Didn't I see the fine print? I continued with the service for over a year, not being able to use the phone except on trips. This service cost me over $1,200.00. I finally was able to get a better service with another company (AT&T) after my year was finished (in my legal name) and at about 2/3rds the cost of the T-Mobile service which I couldn't even use except on trips. I got better phones, better service and respect without any lies attached.

I then asked the T-Mobile people to shut down my account and send me my closing bill. I expected this bill to be about half of what the other bills were (an $80+ average, even though they said it would only be $60+) because I had called them before the month was up. Instead of being half, it was about 3 times more. Regardless, I was glad to get rid of them. I figured I'd make payments on that bill and never have to deal with them again.

I made three payments since I called them in November to close my account; one for $33.00, one for $25.00 and another for $50. Instead of getting rid of them, I get harrassing calls from a service company called Bay Area Credit to collect. I called BAC and told them not to call me on my home phone, that I was making payments on the T-Mobile bill, of which only $75.00 remains. BAC said they would hold up on the calls and give me enough time to write a letter because I needed to put that in writing. Well, the very next morning (I work out of my home) I was in a meeting and I got a call from BAC right in the middle of the meeting.

I'm tired of this. I'm tired of the lousy service I got with T-Mobile, I'm tired of the lies that T-Mobile told me and is telling others with their commercial where a person is screaming over a bill and saying T-Mobile is cheaper then whatever company they got the bill from, I'm tired of the harrassment. Stop calling me and stop increasing the bill (that's another thing I didn't mention...I'm continually being taxed for the same bill)! The bill is being paid.

I found the following note on the Bay Area Credit site:
It just got easier to manage your financial operations and improve your bottom line. Bay Area Credit Service helps you identify and correct financial recovery issues. We are committed to collecting balances due and helping you retain customers.

That and the promise to hold up the calls till I can get a letter off to BAC are just more lies. Get off my BAC!

Sorry, i miunserstood your intentions of your previous post and therefore i apologize. As far as service that you are not getting what you are paying for, i must be a little bit confused as to what you exactly mean, sometimes people define service as "i can use my phone at my house" and sometimes people define service as "when i call, they help me out". what kind of serivce are you referring to? by lookinga t your post, i am going to guess that it is the first of the 2.

As far as that is concerned (and yes, i do work for tmobile and it may sound like i am defending them on this point, but take it how you will) you do have a 14 day trial peroid on the acct where if you were cancel the serivce in the "trial peroid" and return the phone back to where you got it, (usually a dealership) then we will credit back 100% of the charges on the account almsot all the time, including the activation fee and wont charge the early termination fee so that is something that you wouldnt even need to be concerned with. Moving on the the latter of the 2 points (servce being defined as what you get when you call in) i can say, from personal experience, that if you call in and start screaming, yelling,cursing, threatening legal action, demanding a supervisor, you arent going to get S***. if you are kind, courteous, and professional on the call then hell i will bend over backwards to help you out.

On to the tax. what you are probably seeing on the bill is a 911 surchage fee, that is being billed by either your 1) county or 2) city. this is for any time that your account is active (wether or not you get charged the monthly fee) and i know that for a fact that if your account is suspended, (for non pay or otherwise) then you wont get charged the monthly fee (or MAC as we call it) its not that you are getting charged tax on the outstanding bill.

Now, moving on to "them leaving you alone" your best bet is to contact BAC, tell them that you want to dispute the bill, but you dont feel that it is right, even if you do pay them the money, and win your dispute, alot of times they will refund what you have paid, if it is an overpayment. my suggestion is to call them and ask for a payment arrangement and tell them whats going on. and thats the nice thing about being referred to BAC instead of another collection agency, because BAC works well w/ T-mobile in regards to doing the right thing for the customer.. alot of people think that companies love sending you to collections and ruining your credit but alot of the time, companies will only get a small percentage of the amount that is sent to collecions, usually no more than 25%. lets say that you had a balance of 100.00 when you went to collections, t-mobile gets only approx 25% of that (or $25) and BAC gets the rest. and if they (the agency) decide to tack on extra fees, processing fees, intrest, thats all gravy to them. and on the flip side, if you were to stay w/ tmobile, and didnt go over your mins and were a "happy" customer then you spend your $50 a month and make payments on time, we are happy you pay and you are happy you have a phone. now, i am sorry if your phone doesnt work where you live, and most comapines will roll over dead to keep you as a customer,a nd thats why tmobile has put up as many towers as they can possibly get leases for and build as quickly as they can.

bottom line, you may think that companies are evil, like to charge high overage rates, send you to collections, but really, it makes more sense for you to be on a plan that works and you dont go over so 1) you can pay on time and 2) we can get your business, happy customers, make happy companies. i hoep this sheds some light on your situation and gives you some ideas on how to proceed, Cheers!

What Kind Of Rebuttal Is This?? It doesn't address the issues.

I say in my report that "I have been and am paying my bill. In fact, since I called to close the account two months ago, I have made three payments." I don't say that I don't want to pay. That's your erroneous assumption. Also, I say in my report that I never got the service I signed up for. You didn't address that. The employees at T-Mobile lied to me consistently telling me that they would have service in my area (always saying it was only two months away) which I never got.

What kind of a rebuttal is this? You never thoroughly read the report I filed. I filed that report so that the harassment would stop, not to neglect paying the bill. Since you brought that part up, however, I am paying a bill I never really got the promised service for.

Another point which was not addressed during the rebuttal...I am (and said in my complaint that I was) being charged a tax on the remaining balance each time I make a payment and get a new bill. (That is in my complaint and was not addressed in the rebuttal.) That means that I was charged a tax on the first bill and then each time I make a payment a new tax is put on the next bill they send. It's like paying a tax on a remaining balance for a product each time payments are made. It's my understanding that tax is included when a product is sold and not each time a payment is made.

BAC (or bay area credit) is an interum collection agency that is used by t-mobile.. you have not been reported to a quote un quote real collections agency who can be alot more difficult to deal with. as far as getting collection calls, i would suggest making a payment arrangement w/ them to settle the debt or dispute it. bottom line is that you has the service, and used the phone, and now you dont want to pay for it. as far as the charges for early termination, that is something that you agreed to by signing the contract. sorry that it has happened to you, and in fact i hate to see our customers go to collections, but when you have someone who refuses to pay, what else can you do but refer to an agency to try to at least re-coup some of the loss. ask yourself this, you you not do the same thing if it were your company?
