Taco Bell Corp. Yum Brands! I was a shift mgr. that was terminated for unsatifactory performance along with an assistant mgr. we both filed for unemployment and I was turned down and the other mgr. wasnt. Sex discrimination. Deltona, Florida

Myself and another mgr. were terminated for the same reason, we both got it in writing. When we applied for unemployment he was approved and I was denied. Unemployment said the company kicked it back that I was fired.


Unemployment considers being fired as an automatic misconduct issue and you are at fault. Which is not true in this case.


I feel it was sex discrimination on the company's side because the other mgr. was a man and I'm not. He was also told during his meeting with the GM and Area Coach that when he filed for unemployment to tell them (unemployment) the reason was budget cutbacks. I wasn't told anything to the contrary all the mgrs. told me was to apply with a Taco Bell Franchise.


We were unjustly fired anyway due to the fact that the GM at the store did not like either one of us because we asked a lot of questions. When things weren't correct we spoke up and argued the points.


I've worked in fast food a long time and the way I see it is "If you won't eat it don't serve it." I've never been treated the way Taco Bell has treated me and I feel it was unfair.

Ramona, it is not discrimination simply because a male manager makes more than a female manager.  Personal qualifications, merit, and other considerations enter into compensation rates and levels.  The only you would actually be able to prove discrimination is if the other employee was less qualified in every imaginable way - and you were still paid less.  Now, you may even have an opinion as to the other person's qualifications but in the end - it only matters what the documentation indicates and nothing else.

In the end - it turned out that the franchisee made a mistake; you had the paperwork in order and they didn't.  Accordingly, you got the unemployment you were looking for.  Maybe they tried to save money from your perspective - but then you would be wrong there as well.  Unemployment in a franchise business is not something that comes out of the franchisee's pocket; it comes from the state you live in.  The company pays into it, but franchisees will pay a pretty consistent amount from year-to-year depending on their experience with unemployment.  If you don't believe me, take a look at the unemployment check you get.  It will come from the state you're living in.

First off it is discrimination when male mgrs. get paid to do the same job as a female by companies. This is the case. It wasn't budget cutbacks due to the fact after we were terminated they hired in 4 new people at cheaper rates of pay. I filed for unemployment was denied the first time cause the company kicked it back as fired. The second time I filed they kicked it back for other so I was found eligible for it luckily. And as far as it being a franchise it's not it's corporate and from what I've seen they are very good at cut throat crap when it comes to saving money.

Unfortunately, the government (and most of us) don't care about individual opinions because they have no bearing.  In order for this to be sexual discrimination, you need REAL proof.  No opinion.  No supposition.  Your documentation from Taco Bell is all you have to show that you deserve (or don't deserve) unemployment.  If the document you have is clean and shows you were not fired for cause, then you should not have any issues and should be able to collect unemployment.  If there is something more you're conveniently leaving out of the story - then you won't receive a dime.

Logic fails

Either you have a failure in your logic or there is more to this story than you are saying.

You say that the GM hates both of you and that is the reason you were fired.  Now, if both a man and a woman are fired how can it be sex discrimination?

You also say that he tell the man(who he hates) to say it was budget cut-backs, how do you know this?

Then you the woman(who he hates) he says to apply at another franchise.  If he hates you why would he tell you to apply at another franchise?  Wouldn't the only reason he does that is because of the finanical situation at his franchise?  Sounds like budget cutbacks to me. 

You also say you got the reason in writing, so what was the reason?
