I recently was the winningbidder on a 2008 Jaguar XJ8L onEBay sold by Tampa Bay Auto Exchange. The EBay listing contained a description of the vehicle, including but not limited to the options that the car was equipped with. In addition, prior to the winning bid date, I was also provided with additionalwritten advertisement materialsdeveloped by Tampa Bay Auto Exchange which further described the vehicle, including but not limited tothe options that the car was equipped with. Between the EBay listing description and the seller's written advertisement material, it was represented by Tampa Bay Auto Exchangethat the car was equipped with 3 options that were important to me and germaine to my decision to purchase the car: (1) satellite radio; (2) premium sound system; and (3) heated steering wheel.The car was delivered to me via auto transport on Mon. Jan. 3, 2011. Subsequent to delivery, I discovered that the car was not equipped with any of the 3 options listed above. I notified Tampa Bay Auto Exchange via email early morning Tues.Jan. 4, 2011that they had misrepresented thevehicle description andrequested that they reverse the sale transaction and make arrangements to take the carback and to reimburse me for my $525 auto transport cost.

To date, the seller has not agreed to reverse the transaction. Clearly, this is misrepresentation on the part of Tampa Bay Auto Exchange. Their company advertisement materialstouts "we don't play any games with you" and "our goal is to make each and every one of our customers 100% happy with their purchase". This is hardly the case. You don't earn 100% happiness through misrepresentative sales tactics. The proper thing to do in thiscase is for Tampa Bay Auto Exchange to acknowledge their mistake, reverse this transaction, correct their advertising materials, and sell it to a buyer that doesn't care about these particular 3 options.

I do have copies of all written advertisement materials furnished by Tampa Bay Auto Exchange.

how to post documents..

..you need to copy and paste them into a program such as MSWord. You can scan the documents into a text program and save it as you choose.

But, you don't need to do this to prove anything to me. If the vehicle is not as described in the ad and you have documentation..you have legal recourse. How you see fit to handle that is your decision. At the very least you have them on false advertising charges which is illegal in every state and trumps any kind of "as-is" contract.

As far as buying sight unseen online..I would have to agree it is not the best way for the average consumer. I am a pro buyer/seller and have been doing this for over 10 years and I do use eBay for some of these transactions (as well as escrow com). I understand as well since I deal mostly with classic and antique vehicles for restoration and resale that I will need to put money into these cars. That is factored into the resale vs cost..I fix them..have some fun, and sell them at a profit. When I am looking for a daily driver I would never consider purchasing a car before I inspect it top to bottom and extensively test drive it.

But don't get me wrong, I am not in any way criticizing you for making a mistake, or reporting this seller if they were unethical. We all make mistakes and there is nothing wrong with you reporting it here to warn others.

As well, did you try to dispute this through eBay? You know they have buyer protection if you went through eBay motors, as long as you were not sucked into paying via a means they do protect such as check/MO/ or worse yet a wire transfer they can do something. You will most likely be responsible for shipping it back, but the seller may decide to work with you rather then take the vehicle back..that is always the LAST thing a seller wants to do.

Thank you for your response. I'm willing to wager that you are a dealer; at least, it sounds like you are from your post. This complaint is not about the pitfalls of buying vehicles over the internet; we'll all big "boys" and well aware of these. This complaint is about alerting other consumers to the unethical sales tactics of this particular dealer so that someone else is a little more careful than I was and doesn't get scammed in the future. This complaint is also meant to pressure the dealer into acknowledging its unethical behavior and giving them the opportunity to make things right.

So, again, thanks for your sermon, but it's way off point.

I'm A Little Puzzled

Why didn't you check to see if the car had the accessories you desired? Why didn't you look them over during your test ride? I'm a bit puzzled why you didn't do this! Oh, hang on a minute...I just had an inspiration! Yes, that's it...you bought this car SIGHT UNSEEN on the internet! And here we are today with you blaming the dealer. Kind of like you putting on a blindfold and crossing your busiest street in rush hour. Then in your last dying breath, blame the car which hit you!

I've said it before and I'll say it again...YOU took on all the risks when you went thru with this STUPID DEAL of buying a used car you knew absolutely NOTHING about because you never saw it, you never checked it out, you never took it for a test drive and you never had your own mechanic check it out. Unless you've been living on another planet all these years, you've probably heard all the horror stories of buying used cars...even locally. Should dealers be honest? Absolutely! Should consumers use COMMON SENSE when considering a used car purchase? Absolutely. In this case, the dealer definitely scammed you...no question. But you allowed it, you enabled it, you opened the door as wide as it could go so the scamster could take advantage of you.

If you want to buy a used car, you go look at it, you try out all the accessories, you test drive it then you have your mechanic check it out. Just think, if you would have applied these COMMON SENSE techniques, you wouldn't be here now blaming the dealer because the dealer wouldn't have had the chance to scam you!
