I have read and responded to many of your complaints regarding Telecheck and their affiliates. I have experienced what many of you folks complain about, but in my case the problems went on for two years. I tried to settle the situation by writing letters to Telecheck over that two year period, unfortunately, with no success. I was placed in the uncomfortable position of having no other choice but to file a lawsuit.
The case is called Holmes v. Telecheck, in the Middle district of Tennessee. If you or your attorney look the case up on Westlaw you will see the judges recent ruling that largely denies Telechecks motion for summary judgment.
I know how horrible this company can be and the hard hearted, strident approach they take to destroy and humiliate people while they themselves are the purveyors of porn (look up shared global, a wholly owned subsidiary of Telecheck Services Inc. in yahoo, the cache version for those details). That is why Im offering to be a witness for any of you who reach the point of litigation with regard to alleged violations of the FCRA, FDCPA or Unfair and Deceptive Trade Practices.
We have got to stick together so the merchants can verify for themselves whether the customers at their registers who are being rejected and humiliated are a bad risk or not. Let the merchants sit in the courtroom and watch how Telecheck treats their customers and decide if this is a partnership they want to partake in. My trial starts in Nashville, February 19.

Very important.....I forgot to mention that it's important for you to contact your state Attorney General. They keep track of the number of complaints filed against a company and if they see a pattern and practice they may file a lawsuit on behalf of ALL of the citizens in your state. This is what happened in West Virginia and with all of the postings I see on this board, may also happen in other states too.
I also hope you didn't misunderstand my initial posting. If you end up having a trial I definitely am willing to testify about my experiences with this company (that will help the jury to see a pattern a practice) but I am not an attorney so I don't know that I can offer you any other personal suggestions at this point. You need a professional to dertermine what your next step will be. As you can tell by the redaction above, there is no way for individuals to communicate directly, I think that may be Ed's policy.
Have your attorney look all this information over and if I can help by being a witness and testifying at your trial, he or she will definitely know how to get in touch with me.

My case is cited on Westlaw (as mentioned above) and my trial starts next Tuesday. There is a good possibilty that more information will be published in various ways and if that's the case, I'll post it here and hopefully that information will help with what ever mysterious questions you have.
In the meantime (I think I've mentioned this in previous posts) the National Consumer Law Center is a great organization and really fights for consumer rights. You need a lawyer in your home state, and if you don't already have one, they will give you a referral.
I really hope these suggestions help with your situation.
