I purchased a Yaesu FT-8800 ham radio from Ebay seller ESTOPELECTRONICS. He also has 2 websites WWW.THEANTENNAFARM.COM & WWW.ESTOPELECTRONICS.COM. The item sold on ebay for $369.95 with a shipping fee of $9.95 and I sent him a total of $379.90 within seconds of the auction ending via PayPal.
I never recieved the item that I paid for. When contacting UPS with the tracking info they said that acording to the tracking info it was left on the front porch. It was either stolen from the front porch or their is some funny business going on with UPS. I contacted the seller and told him that I never recieved the item. He claims that because he shipped the item on his UPS billing act using my UPS account as the billing method that I was the one that would have to file a claim through UPS.
I contacted UPS and they stated that the shipper is the one and only person that can initiate a claim or a tracer on the shippment. I again contacted the shipper/seller and told him what UPS said and he said well that is not right and eventually he contacted them and iniated a tracer on the package. The seller scanned the claim documents and posted them on his website and provided me with the link and they stated that the claim has been approved and they were not able to find the item.
I contacted the seller again via email stating to him that I wanted the origional radio that I paid for and he said that he would not upgrade the shipping for free even after all of the crap I have had to go through with this horriable purchase. He would not upgrade it so I told him to just mail me a check then I thought to myself I had better not do that because of his actions so far I dont trust him then I informed him to refund it back to my PayPal account the same way that I paid him for the item. He didnt respond to my email all day then he finally did and here is the email that I recieved.
Obligations for the release of funds have been sent to your eBay account. Please log onto your eBay account to release obligations of sale.thank you and good day

I logged into my ebay account and their was nothing their nor did is say anything about this. This is just another way for this individual to try to get out of paying me my money. Here are some other emails I have recieved from him.

I called UPS a few minutes ago, I explained the circumstances and they told me that the claim has been approved in their system. I can go ahead and ship you a replacement tomorrrow or give a refund.
As far as waiting? No, this is NOT normal but neither was this transaction. In 7 yrs in business I have never had a loss when shipping on someone elses account. Plenty of loss when shipping with my own. Remember we both were under the impression that you had to make the claim since it went on your account. This caused a long delay in getting this done.Under NORMAL circumstances a replacement would have been issued immediately and shipped overnight. Remember..we all live in a world full of human beings. I am one of them and I am not immune from error or misjudgements and I assume you fall in that catergory as well.
You will be able to get the UPS charges that fell on your account for the next day air charges by calling UPS and requesting them (if you have'nt done so already). They will be able to check that the claim for the pkg has been made and they will refund your shipping charges.

Yes..I think at this point a refund would be best. Since you have moved sending merchandise to a different address other than what's listed in the original sale on eBay and your Paypal confirmed address is not in accordance with credit card agreements, eBay or Paypal policy. Thus neither one of us would be covered under credit card user agreements and would put us both at jeopardy.

Thats kinda weird cause he sure accepted my credit Card payment through PayPal. It was good enough for him to accept but now PayPal is not good enough for him to send me back my money. This is just another way of stalling or trying to get out of refunding me my money. And he is only saying that he will refund me $369.95 when I sent the guy $379.90.
Then he emails me this which is totally counterdicting his previous email.

I cannot refund the original Paypal payment since it has been over 60 days. The only way I can do anything with Paypal at this point would be to SEND you the funds...if I did this however Paypal would charge you a fee as if you were receiving funds for payment. If you are ok with these fees ($8-$12) I will do that for you, otherwise I can send you a check

So I agreed to having PayPal take their fees out. If would be better than not getting nothing at all from this guy. Then after he send me this email stating that he would refund me my money via PayPal he send this email.

Regardless of how you feel this transaction will be handled in a legal way and while observing eBay and Paypal policy. A check in the amount of $379.90 shall be sent to the address you provided below. Once the certified bank check has been cashed obligations surrounding this transaction will be satisfied. This is what the law requires and is the same your local DA (had this been a local transaction) would expect out of me.

Then he states now that he will not send me back my money via payPal but he will send a check instead. I stated to him that I will not accept any other form of refund except via PayPal bacause its safe and if he tries to pull something off PayPal will investigate it. So now he styates that he is going to send me a check which I doubt that I will ever recieve. I have completely and totally informed him that I will not accept any money from him other than PayPal.
This is nothing but a way for him to either scam me or he is broke and has to rake up the money to give to me. Apparently he already spent the claim check from UPS. Im also going to call UPS and see how much he made the claim out to be. I have a feeling that he gave them a amount over that what he should have. If he has I will contace the UPS invistiagtions dept. I am also contacting his local DA,Police dept,His states attorney generals office regarding Cyber crimes and the FBI. This situation has gone on for too long and he is just making it worse. Just look at his emails that he sent to me. You can clearly tell that something is not right on his end.

Not very good liar

Although I eventually received my item, this seller is a liar, and not a good one at that. He told me something in private, and said the opposite in a pubic forum (or he's just really dumb, and can't do simple, single digit math). He accused me of being a liar in the process.
Eitherway, don't buy from this guy. He will lie and accuse the buyer of being wrong when he messes up.

The Antenna Farm is not an Authorized Dealer for any of the radio products they sell.
Gray market product is what you wil get. Call Icom/Kenwood/Yaesu and they will all tell you he is not Authorzied to sell anything.

I have never had an issue with ESTOPELECTRONICS. When I purchased my IC-207h from them a couple years ago they shipped the radio very quickly and it was at my door within a week. I have no complaints at all about this company, they seem like a class act and respect their customers.

This is a very one-sided report about Mr. Holbrook!!
I found Mr. Holbrook on Ebay about five years ago while i was vacationing in Naples, Florida. He had some radios of interest to use for hunting and work related purposes. Since I knew nothing about them he invited me to his home/office in Ft. Myers at the time where he was working out of his garage. I actually met his wife and small children while looking at his products. Since that time i have purchased over one hundred items from him and been completely satisfied. He even ships me products without a check or credit card. John is a nice family guy and it upsets me to see him slammed on this site for a mishap involving the shipper loosing a radio and this gentlemen not being very patient. I have been in law enforcement for most of my adult life and a pretty good judge of character and i can honestly say Mr. Holdbrook is HONEST.

Dear Mr. Holbrook:
This is an official CITATION, issued pursuant to Section 503(b)(5) of the
Communications Act of 1934, as amended ("Communications Act"), 47 U.S.C. S
503(b)(5), for marketing an unauthorized radio frequency device in the
United States in violation of Section 302(b) of the Communications Act, 47
U.S.C. S 302a(b), and Section 2.803 of the Commission's Rules ("Rules"),
47 C.F.R. S 2.803. As explained below, future violations of the
Commission's rules in this regard may subject your company to monetary
forfeitures.
Your response dated December 5, 2005 to our Letter of Inquiry ("LOI")
issued on November 22, 2005, acknowledged that you marketed an uncertified
radiofrequency device for Citizen's Band ("CB") use, the Magnum Mini radio
transceiver ("Magnum Mini"), through your web site,
[1]www.theantennafarm.com. Furthermore, you indicated that upon receipt of
our December 5, 2005 letter, you ceased marketing the device and
discontinued offering it for sale on your web site.
Section 302(b) of the Act provides that "[n]o person shall manufacture,
import, sell, offer for sale, or ship devices or home electronic equipment
and systems, or use devices, which fail to comply with regulations
promulgated pursuant to this section." Section 2.803(a)(1) of the
Commission's implementing regulations provides that:
no person shall sell or lease, or offer for sale or lease (including
advertising for sale or lease), or import, ship, or distribute for the
purpose of selling or leasing or offering for sale or lease, any radio
frequency device unless ... [i]n the case of a device subject to
certification, such device has been authorized by the Commission in
accordance with the rules in this chapter and is properly identified and
labelled as required by S 2.925 and other relevant sections in this
chapter.
In addition, Section 2.803(g) of the Rules provides that radio frequency
devices that could not be authorized or legally operated "shall not be
operated, advertised, displayed, offered for sale or lease, sold or
leased, or otherwise marketed ...."
Section 95.409 of the Rules, 47 C.F.R. S 95.409, specifies that CB
transmitters must certified. Accordingly, the Magnum Mini must be
authorized in accordance with the FCC's certification procedures prior to
the initiation of marketing in the United States. The Magnum Mini, as
advertised on your web site, operates on 400 channels within the 25.164 to
29.655 MHz frequency range, at an output of 15 watts peak envelope power
in "AM mode." This frequency range, as well as the number of channels, are
clearly beyond what is authorized in Section 95.407(a) of the Rules, 47
C.F.R. S 95.407(a), for CB use. The transmitter power for the Magnum Mini
also exceeds the levels specified in Section 95.409(a) of the Rules, 47
C.F.R. S 95.409(a). Furthermore, Section 95.425(c) of the Rules, 47 C.F.R.
S 95.425(c), explicitly prohibits the operation of CB transmitters on
unauthorized frequencies or illegal power levels. Thus, the Magnum Mini
apparently does not comply with the FCC's technical standards, and
therefore would not be capable of receiving a grant of equipment
certification. Accordingly, it appears that Estop has violated Section
302(b) of the Act, 47 U.S.C. S 302a(b), and Section 2.803 of the Rules, 47
C.F.R. S 2.803 by marketing in the United States a radio frequency device,
that is not authorized and is not eligible for authorization.
If, after receipt of this citation, you violate the Communications Act or
the Commission's rules in any manner described herein, the Commission may
impose monetary forfeitures not to exceed $11,000 for each such violation
or each day of a continuing violation.
You may respond to this citation within 30 days from the date of this
letter either through (1) a personal interview at the Commission's Field
Office nearest to your place of business, or (2) a written statement. Your
response should specify the actions that you are taking to ensure that you
do not violate the Commission's rules governing the marketing of radio
frequency equipment in the future.
The nearest Commission field office appears to be the Tampa Office in
Tampa, Florida. Please call Gabriel Collazo at 202-418-1160 if you wish
to schedule a personal interview. You should schedule any interview to
take place within 30 days of the date of this letter. You should send any

Since you are reluctant to log on to your eBay account to set the record straight a check is the only way for a refund 60 days since the transaction took place. You may call Paypal and they will inform you of the same thing. Every major business in the US follows the same policy anytime credit cards are used without the use of a credit card processing machine at the place of business. Your credit card was processed online, not in person where the card is swiped and a receipt was signed by you. Therefore a cancelled check bearing your signature is the only way to satisfy credit card processing companies and the law. Wal-Mart and Home Depot all follow the same rules, just to name a few. If you refuse to cash the check I am sending you that's your decision. Regardless, a check will be issued for refund.
Your reluctance to log onto your eBay account and set the record straight throws up a red flag and makes this transaction all the more suspicious and gives me all the more reason not to trust you with a Paypal payment sent to settle a refund. Regardless, your claim has been made and will be settled and a certified check in the amount of $379.90 will be sent to the address you provided below.
Whatever charges you claim to be filing against me, Estop Electronics, Inc or any of it's beneficiaries will be filed falsely. All emails between us (including HEADER strings) are on the record and will satisfy any district attorney in the country (along with a cashed certified check sent to you).
Keep in mind, that if you cash a certified check then make an attempt to claim you never received a check, any charges filed falsely against I or Estop Electronics, inc will be pursued to the fullest extent of the law.

I have closed my ebay account solely because of this lying seller so how am I suspose to log back into it. My paypal account is still open their is no and I mean no reason that he cannot refund me back my money via PayPal. Its just another excuse.
