I had the following "Demand for Payment" letter delivered to The Clusters Apartments on Thursday, November 29, 2007.

"The Clusters Apartments
3130 Webb Chapel Ext.
Dallas, TX 75220

To Whom It May Concern:

I am a resident of The Clusters Apartments unit 218. Recently I have been car pooling to work with Resident of 309. Resident 309 is a current resident of The Clusters in unit 309.

Friday November 16, 2007 at 7:50 am, Resident 309 discovered that his car was missing from the resident parking lot. After some investigation on his part, he informed me that his car had been towed to SW Auto Storage LLC. SW Auto Storage informed Resident 309 that his car had been towed because the Visitor Parking Tag had expired.

Without a car, there would be no way for Resident 309 or me to get to work. With no other alternatives, I contacted Dallas Yellow Cab to take Resident 309 and me to SW Auto Storage LLC to retrieve his vehicle. Unfortunately, Resident 309 was unable to pay SW Auto Storage LLC to have the car released to him. Consequently, I used my debit card to pay the tow and storage fee. As a result of this inconvenience, I was one (1) hour late for work.

Later the same day, Resident 309 went to the Leasing Office of The Clusters and repeatedly requested another Visitor Parking Tag. According to Resident 309, the Manager and Leasing Agent refused him a new tag. Both withheld reason for the refusal.

Monday November 19, 2007 at 7:10 am, Resident 309 once again discovered his car missing from the resident parking lot. He immediately called SW Auto Storage LLC. SW Auto Storage informed Resident 309 that his car had indeed been towed. Again, I contacted Dallas Yellow Cab. Once we arrived at SW Auto Storage LLC, Resident 309 attempted to retrieve his vehicle. I was prepared to pay for the tow and storage fee since Resident 309 was unable at that time. The clerk at SW Auto Storage LLC informed Resident 309, in my presence, that the police would have to clear the vehicle. Neither Resident 309 nor I knew what that meant. Resident 309 requested further information from the clerk. The clerk responded that Resident 309 would have to call 911. Resident 309 did accordingly. He was informed that he would have to wait for a police officer to clear the vehicle.

Fearing I would yet again be late for work, I flagged down the taxi that brought us to SW Auto Storage LLC before it left the parking lot. Resident 309 and I took the taxi, first, to an ATM on my way to work. I gave Resident 309 cash for the tow and storage fee as well as cash for the taxi. The taxi took me to work in Carrollton and took Resident 309 back to the apartments where he waited to hear from the police department regarding the release of his car.

At around 1:30 pm the same day, Resident 309 was informed that a policeman had arrived at SW Auto Storage LLC so he took a taxi back to the storage facility. Once Resident 309 arrived, he was informed by the policeman that his vehicle had been reported stolen. The policeman concluded that the car did indeed belong to Resident 309 and that it had been falsely reported stolen. Resident 309 paid for the tow and storage with the cash I had given him.

For various reasons, of which I have been made aware by Resident 309, I believe that Resident 309 has been a victim of retaliation by the Property Manager of The Clusters as outlined in Chapter 92, Subchapter H, Texas Property Code 92.331 Retaliation by Landlord. This belief has been validated by the Leasing Agents own admission to Resident 309 and Mr. Harris, his roommate, regarding the Property Manager.

The following verbiage is clearly stated in the terms of the lease:

We will give you at least 10 days notice that the vehicle will be towed or removed.

To my knowledge and by Resident 309s, no written or verbal notices were given prior to The Clusters Apartments authorizing the towing of Resident 309s vehicle either time.

The actions of The Clusters taken against Resident 309, whether with malicious intent or not, have cost me a considerable amount of money. Please see an itemized list below of the resulting charges and the expenses incurred.

Grand Total: $478.63

Please remit a refund of the total amount of these charges via check, money order or cashiers check within 5 business days of the receipt of this letter. If I do not receive a refund for the grand total shown above, I will file law suite against The Clusters without hesitation. In the law suit, I will also file for the attorneys fees, court costs, lost time at work, and any additional damages I am entitled to under the law.

Thank you in advance for your anticipated prompt attention to the closure of this matter.
