I take an oath as a Babtist Christian man this is the absolute truth... I have all emails in original form, untouched, to prove what I say.

Before Westdale Asset management bought the Lakeway Apartments in Garland Texas, I had serviced the carpet cleaning for 17 years.

After Westdale bought the Communities the Supervisor over Maintenance wanted to meet with me. It just so happened he needed the carpet cleaned in his truck so while my employee cleaned the carpet He and I went into the office to talk.

During that meeting Mr. Thweatt told me he was "seriously amazed" at how well we cleaned some of the carpets he had seen. Mr. Thweatt then assured me that as long as he was Maintenance supervisor I "would have all the carpet cleaning". I felt this was an oral contract and ended the meeting with a handshake. This was in 2006.

All went well until August of 2008. I had posted a good luck wish to my nephews that are hispanic, I am white. My webpage simply told them I love them and wished my youngest nephew good luck in baseball, he is in college and is good enough he will make the majors. I had also bragged a little on them to some of the office staff, Including Mr. Thweatt. When I mentioned the last name Delegarza... He had a look on his face like I had just said something wrong, but nothing was said.

August 25th 2008 I received an email only to me.. header copied and pasted:

The email is too long to post but starts off saying white people are preyed upon by blacks and mexicans. The emails says : They rob us, car jack us, but we have to pay for their welfare. Also states it should not be racist if a white cop beats up a black or mexican gang member.

Now please keep in mind, I did not know this man very well. I only knew his last name because of his email address! Never had lunch with him, never spoke of anything that was not business related and NEVER asked for this trash on my email. I did not respond. Just saved under a folder titled "uncomfortable" thats how it made me feel.

Why would this type of email go only to me? only a couple of weeks after I mentioned my hispanic nephews? Well, He is the type of controlling man that wants his views known, If you go against his views then you are gone.

I remember one time I was so embarrassed because a television program was on in Lakeway Colony workout room, I walked past to get a key for an apartment and he said come here johnny... look at this ((((REDACTED FOUL LANGUAGE))) on t.v. ..It was an ex-employee that was on the Dr. Phil show. She was getting help for her daughter that would sneak out at night. Mr. Thweatt said "she will end up a s**t just like her mom, then she will ((((REDACTED FOUL LANGUAGE))) some ((((REDACTED FOUL LANGUAGE))) and move in with a little tyrone, jungle bunny" I was offended and made an excuse that i had to get over to an appointment quickly so i left. This incident occured months before I received the email above. First, the lady was trying to get help, second, I have known her for 15 years and last but not least shut up!

I was always too afraid to say anything, I never complained but just smiled and moved on. I often thought about the oral contract but I still did not want to stir anything up so I put my head down and minded my own business. What a kick to a persons self esteem. Yes I was ashamed of myself from about July 2008 until Feb. 2009.

Back to the future.... November 2008 I called Mr. Thweatt to get permission to charge for paint removal on a carpet in #409 at Highlands at Galloway apartments. He said hold on I will be there.... He looked around at the massive amount of paint on the carpet, then we walked to the back bedroom and he said "you need to get with the painters to figure out this overspray problem" (it was happening on 8 out of 10 cleans) I thought Why should I have to get with them? Isn't that your concern? I am just a contractor cleaning carpets... then he huffs up and walks out the door and says "you need to watch out for Adolfo over at (Lakeway) Colony, He hates white people and he is wanting a mexican to do your job!!!!!! WHAT???!! was this a comment about my nephews>? was this true? why would he say that?

Well, the racial emails continued about one a month (8) total. I have them all, final email in Feb. 2009. While my wife was having abdominal surgery at Lakepoint hospital in Rockwall. He knew, because I told everyone that I would have limited phone service at the hospital. But he sent me an email saying he was getting other carpet bids.... I thought no problem, I had not been out there for 17 years by luck, my prices were cheap and all my work was guaranteed.

Next 2 jobs were assigned at lakeway colony (Adolfo, I mentioned earlier) my employee arrived but maintenance was still working so we returned 2 hours later per their request. we arrived the carpets were cleaned already by another company. The company is Hispanic... so was Jimmy Thweatt right? Adolfo Hates white people?

This time I asked, whats going on. Oh we decided to use another carpet cleaner! I asked did we do something wrong, or make someone mad? The reply was No, no one is mad, you did nothing wrong it's just the economy.

O.k. I said I would do all cleans, no matter what for $50.00 across the board and fully guarantee them..... no reply.

After Feb. I no longer received work from westdale management. My employee then told me Jimmy Thweatt tried to solicit him to get his own carpet cleaning equipment and he winked at him and said "I will keep you busy" this was done because my employee told him he could not afford a dirtbike at this time to go riding with Mr. Thweatt. So I guess Mr. Thweatt does what benefits him... my employee of 10 years said no, I leave that part to Johnny. Mr. Thweatt quickly said well, I got to go fax this stuff.

From my emails I have as proof I see Mr. Thweatt does not respect Black people, Hispanic people, or white people with blacks and hispanics in thier families. Adolfo From what I have seen and what I was told by Mr. Thweatt hates white people.

I wonder why apartments are sitting vacant for months. From November 2008 thru Feb. 2009 they would schedule carpet cleans before vinyl was installed and makeready was done on vacants... then blame me for spots on the carpets!! We always went in last, when I asked them they said they need them ready just do it. I think that was a set up to say my carpets were not cleaned well.

Emails and written proof do not lie! If an attorney thinks I have a case please contact me! I have (8) emails total all are degrading to blacks and hispanics, and me! Some of the headers on these emails showed they were sent to other Westdale employees... I thought for sure after that they would stop.. but each month I would get one or two.. until my final email in Feb. I have heard Mr. Thweatt refer to girls in the offices as nothing but "a*s". I had an oral contract, a business 17 years in the making that was worth about $350,000.00 now it is worth a penny. All because of racism, I never thought this stuff would happen in 2009!

I should write a book with all I know and will swear to have seen them treat white people differently,But with a black man, one of the nicest people I ever met, He was concerned about his health, what do they do? paint over mold ... i told them it has to be cut out mold grows inside walls it has roots .... "o.k. thank you" then two days later they send me in just to clean the carpet, and baseboards broken up... but painted.. .. this tells me the sheetrock was not replaced. What about the studs in the walls? So at no charge I put and ozone generator in this mans apartment, and a dehumidifier to draw moisture from the walls because I feel I have to help as much as I can. No charge, Resident told me he noticed better breathing in about (4) hours after I put it in, I left it with him for 2 weeks, I checked back on him. Never did the office even thank me ... they just said you need to get your machine out of the way so the painters can touch up painting!!! That was at Lakeway Meadows 257 building I think 110 almost positive on that. BUT THEN lakeway place 605-107 older white couple... carpet barely damp around a windoe from a fresh water sprinkler head outside. Mr. Thweat orders us to : "move all furniture, pull all pad, relay pad, put blower, and dehumidifier in plus ozone generator.... then come back and clean all carpet in 2 days..... Hmm ...

then man at Lakeway Meadows was a much bigger flood ... but maintence did that one to save money! I save money too, but money does not compare to health and quality of life. Sorry I should have ended this complaint long ago if you have read it all please know that I appreciate your interest, Thank you for at least looking at what I have said.
