I joined the Alcoa location in May 2008, in early 2009, I requested to transfer locations. In April 2009, I injured my back and was unable to go to the gym. Once I was able to figure out my back injury, I asked the General Manager at Chapman location what I needed to get my training money back $340.00 and get out of my membership. I was told I had to write a letter and get a signed Dr's note showing my medical need to be let out of my membership.
I was then told by the Corporate Office (KYLE) that I would not be getting a refund of $340.00, and that I OWED them $133.00 for the money that was due on my contract.
I was never able to obtain a copy of my contract where it showed that my training money was non-refundable.
I gave up in defeat and paid the $133.00 in person at the Chapman location. I WAS NEVER told I had to hand in the "KEY card" that you attach to your key chain to scan into the gym. I never got a collection letter, nor call from them until today.
They sent my "account" to a Maryland Collection agency for FAILURE to return the KEY CARD, and are trying to collect/sue me for the full amount due on the three year membership I signed up for in May 2008.
I signed up for a three year contract. I paid from May 2008 until August 2009. They are sueing me for an additional 11 months??? $29.95 divided into $946.00 is 31.58 months.
