The RV Man Green Valley RV Inc, Failure to pay consignment sale Colton California

Consigned travel trailer 12/22/17. Was told by sales person Lisa at the end of January 2018 that she sold it. I walked into the dealership to check on things. Never received a call that they sold it. Went back in February to find out payment info. Again we sold it. Have been emailing and calling for payment since February 2018. Contract reads per DMV regulations that 20 days after sale payment should be completed. They said they sent a check March 14 and Lisa text me a picture of it. Check 008711 for 11500.00. It never posted to my account. I called back 1st week of April. Check must be lost. Spoke with Bob Orland he talked to Paul the owner Paul said he would stop payment on that check and walk payment into my bank the next day. 2 weeks later that still has not been done. April 18/ 2018 and I am still making payments on that vehicle and it has not been paid by The RV Man. They will not give me an official date of sale. I have emailed Dave Gorman in finance and Bobby Canale in consignments. No replies whatsoever. I get the run around and stalled and lied to. Went to reviews of this company and it turns out I am not the only one they are doing this to. It seems to be standard practice. I filed a complaint with BBB waiting to hear.

I am now going to report them to DMV for failure to pay on terms dictated by the DMV. To sue for breach of contract would take more money out of my pocket and recovery would only net the contract amount owed. No penalties to the company for breaking the contract. What recourse does a consumer have to get what is rightfully theirs? They received free inventory and a few thousand dollars profit for my goods with failure to pay the balance owed to me. We need protection from this kind of theft. Thank you.
