The Tax Club ripoff dishonest representation fraudulent practice Tempe Arizona
I am asking for a refund of $750. I am not satisfied with what has been represented and have not received any services for the money I have been charged.
I was approached in April of 2006 to seek a free consult with your company as a result of enrolling in a program through the John Beck organization. On June 23 I spoke with Mr. Bert Seither stating that he was from The Tax Club. He provided a 30 minute free consultation. At that time he informed me that the Tax Club would provide services based upon an annual rate. He took information and I was informed of what the Tax Club would do and commit to do for the first year. There was a recording of the conversation explaining the commitment of the Tax Club but no where did the recording or my conversation with Mr. Seither indicate that I was committing to the year. There was also no conversation nor information indicating a time limitation in cancelling the service if I did not feel it to be satisfactory.
On July 6, 2006 I sent an email to your company website asking for a refund of the $750 that had been deducted from my credit card. I received an email from a representative of the tax club on July 7, 2006 indicating that my account had been cancelled and that I would not be billed further. It also indicated that my request for a refund would be reviewed and responded to within 30 business days.
On about August 23rd, Erica who indicated that she was a representative of The Tax Club called and informed my wife that we had committed to the year of service and could not get a refund of the $750. She indicated that we could still get our taxes done with the current payment of $750 and then beginning in January of 2007 we would be obligated to pay $14.95 per month. I attempted to contact her numerous times over the course of the next 7 days and was able to reach her on August 31st. At that time she played back the tape of the conversation on the 23rd of June.
I had informed her that I had received an email cancelling my account. She then indicated that she felt the recording indicated that I had agreed to a one year commitment and that the $750 could not be refunded. She again stated we could have our taxes done for the $750. I informed her that the recording was a statement of the commitment that The Tax Club was making for the one year period and never mentioned my commitment. I informed her that I had not been sent any written information nor had I provided any written commitment for ongoing services. I also indicated to her that there was not any mention of a time limit regarding cancellation. She indicated that she could reduce the amount to half, $375, and that I could come away with something. I informed her that I did not agree with her assessment of the situation and that I wanted the refund of the entire amount. She declined.
I find it unfortunate that your representative would try and misrepresent to us our obligation to your service for a year when I had already received a cancellation notice. By virtue of that cancellation your company had established that I was not obligated to the service and that you have established a cancellation precedent in this case. Since I have not received any service other than the stated free consultation, I am asking that the entire $750 be refunded. I see that a number of other complaints have been filed regarding dissatisfied customers since March of this year and that the company has come to the attention of the Better Business Bureau of New York as well as Arizona. I was also pleased to see that a number of those complaints have been resolved satisfactorily. I trust that mine will be as well. Thank you for your consideration in this matter.

The Tax Club responds with refund

I contacted The Tax Club again after I had filed this Rip Off report and also filed a complaint with both the New York and Arizona Better Business Bureau. The Arizona Bureau was very reponsive and helpful.
The Tax Club contacted us and offered to refund all but $75 of the original amount. We accepted the offer. I was impressed with the helpfulness of the Arizona Better Business Bureau of Phoenix. The dispute resolution specialist with the Phoenix BBB that helped us was Carol Dockstader, 602-212-2214. I hope this is helpful to others.

I have dealt with the same company and undergoing a problem with them. Please see my own thread and complaint that I posted.
It appears I have dealt with Erica too on the phone. She's absolutely no help at all.
I would suggest you contact the John Beck Organization, you may find out that they aren't affiliated with the Tax Club at all and sold you their service on false statements, like they did with me.
Based on this, we should be able to do take this to court and argue their Terms and Conditions are not legal and valid, therefore contract should be void. I would be open to filing a class action lawsuit for everyone sold these services based on false and misleading statements and deceptive practices.
