On Febr. 20, 2010 my fiance and I succumbed to a persuasive sales pitch and purchased a timeshare at Villa Del Palmar Flamingos, Puerto Vallarta, charging the $8,000 down payment on a Visa card. The contract specifically provides that it cannot be cancelled, even for "buyers' remorse."
We contacted Mexican counsel approximately 10 days later about how to cancel the contract. She advised that Mexican law provides a 5-day right of cancellation. Had the contract contained this information, we would have exercised our cancellation rights within the statutory period.
Our position is that the contract conflicts with the law of Mexico and is therefore invalid. Has anyone else been successful cancelling a similar contract and recovering the downpayment?
