On September 16, 2017 I was the winner of 7 different size violin lots with a total of 21 violins via the platform of liveauctioneer.com. On September 18, I called Thos Cornell auction house and I made payment of $3562 over the phone for the violins and I told them that I will be picking up my items on Wednesday, I was told that they are not open on Wednesday, so I said that I will be picking my items over weekends the, and the employee told me that it was ok to come over the week end. When I drove from Boston to Bellport.NY to pick my items I was told that supposedly somebody pick them up before me, and that because my name is not a usual name and the person that pick them up had an ascent and that the auction house worker couldn't understand him so she concluded that it was me and gave him the violins. We called the county police department and we filed a complaint. We agreed me and the auction house owner to refund me the money I paid plus my expenses for 1 night hotel stay (Since I drove from Bosotn.ma to pick the violins), gas plus the two days that I to took from work as lost wages. Thomas Cornell the owner of the auction house gave me two checks with a total value of 4125$, but when deposited into my account the check bounced. Because payment was stopped on the checks by the owner, knowing that I live in Boston I could not go back to the auction house right away. All I am asking for is refund for my money plus expences I lost because of this transaction wich is $4125.

THOS. CORNELL GALLERIES, LTD. has been the victim in this situation and has done nothing wrong. 

This case is still active and under investigation.

 

#1 The gallery is only closed on Tuesday and Sunday.

Mr. Labyad was NOT told that THOS. CORNELL GALLERIES, LTD. was closed on Wednesdays.

#2 THOS  CORNELL GALLERIES, LTD. called the police department to report the missing violins not Mr. Labyad. A policewoman responded, took the report and said that a Detective would be arriving later to investigate.

Feeling terribly that this unfortunate incident had occurred and because Mr. Labyad demanded $1000.00 in compensation for incurred expenses for gas, hotel fees and taking 2 days off work in addition to his purchase price we gave him a 2nd check for the amount for the amount $1000.00 that he was demanding.

The SuffolkCounty police Detective arrived after Mr. Labyad's departure and felt that there was the possibility of a scam involving more than one party and we were advised by the Detective to go to the bank on Monday morning and put a hold on the checks.

The bank does not put "holds" on checks it either stops payment or lets them go through. Based on what the Detective told us a stop payment was put on the checks. A few days later Mr. Labyad called in an agitated state where he was not easy to speak with and refused to acknowledge the situation.

At the end of the week no resolution had been made and THOS. CORNELL GALLERIES, LTD. decided to reissue new checks and sent them by US Mail return receipt requested to Mr Labyad. The checks were promptly cashed.

#3 Mr. Labyad received compensation in FULL plus expenses totaling $4,125.00 It is not understandable why Mr Labyad needed to take off work for 2 days since he only lives approximately 260 miles away nor is it understandable why he needed to spend 2 days traveling and stay in a hotel in order to get to Bellport Long Island New York.

This case is still active and under investigation.
