A TMG field rep was dispatched to my florist shop to present an offer for a merchant account (ie credit card processing). We informed this rep that we had two open merchant accounts and he received authorization by phone from his supervisor to write a contract by which TMG would pay off the lease agreements for both contracts before contracting with us.

Additionally this rep informed us that when TMG payed off the open lease agreements we would be able to keep the leased equipment and dispose of it as we saw fit. TMG did in fact pay off one lease agreement but did not pay the second. Upon my inquiry I found that the field rep had conveniently neglected to write a previous lease pay-off option for the second company into the contract. Naturally when the field rep was questioned he said that his supervisor would have to rectify the problem.

Repeated calls to the supervisor brought no satisfaction. After about a week of trying the supervisor claimed he had forwarded all the necessary information to the proper department to get my complaint resolved. Days passed before I repeated my inquiries and after MANY calls to various departments and reps I was informed that TMG would not pay off the second previous lease. A "supervisor" informed me that the company had no obligation as a contract was never written. I also learned that TMG had payed off the one lease agreement at a lower rate and I would be required to send back the leased equipment.

I contacted my field rep on 3/25/10 to discuss the matter and he acknowledged once again that both he and his supervisor were aware that TMG had agreed to pay off two previous loan agreements, and that he would rectify the situation the next day. There has been no progress to date. By the way, this contract with TMG was initiated in January 2010.

My experience in calling to deal with TMG reps has been that EVERYONE of them put me on hold for 15 -20 minutes each time I called. This is not an exaggeration. Nearly every call was disconnected by TMG before any progress was made, leaving me to have to call back and start the conversation over with a different rep. Not one rep would provide a direct phone number to his or her superior. Their organization is designed to thwart your attempts to speak with the decision makers. They do not know the meaning of "customer service", and will obviously omit crucial elements of contracts to their benefit.

To Scott, I hate to read stories like yours.  Unfortunately the leases are ironclad and your
best recourse is to sue Trans Tech Merchant Group for beach of promise if you have proof.  Maybe get the sales rep to provide a written statement.  Most likely he does not work for them now, so maybe he will be willing.  I can assure you not all companies in this industry are like this.  Always get it in writing, never accept a verbal statement.  Beware of Trans Tech Merchant Group (TMG) and their apparent sister companies like Summit and Apex.  I have worked in this industry for years and have dealt with many companies.  The customer service is poor.  Should you need to call them you will waste a lot of time on the phone holding.  When you send in a cancelation request never assume they have it, always follow up with a phone call.  They may claim we do not have a record of receiving it.  The after they admit they have it, "it will take 30 days to process".  This just gives them another month to charge you another monthly and minimum fee.  The contacts are written so that not matter what rates you sign for in the initial agreement they can add any fee without any recourse unless you want to cancel, but then you will need to pay a termination fee.  If you sign up for PIN Based debit service it is a separate service and a different cancelation fee.  They lease equipment which is an expensive way to acquire equipment.  In fact all credit card equipment leases I have read, you never own the equipment until you have fulfilled all payments, but then you need to buy the equipment for the residual value.   Not smart! The processing rates they charge are average at best.  If you are a business owner that has been burned by TMG, flight them by complaining to local and state consumer agency.  If they get away with it they will continue
harming others. Ray with Tampa Bay Merchant Services

The Inevitable Lawsuit Has Been Filed

AUTHOR: Scott - (USA)

POSTED: Wednesday, October 19, 2011

It is now October 2011 and we are being sued by Lease Finance Group, the contracted provider of credit card processing equipment working in tandem with TMG. As TMG failed to make good on its original contract with our store, and locked us into a long-term "non-cancellable " lease agreement we are the subject of this lawsuit. LFG is suing for three years worth of leases on their equipment even though our business has failed and their leased equipment has been returned. Of course they want interest, lawyers fee, and penalties in addition totaling over $8,000.00  This is the most outrageous and ridiculous hardship being imposed upon us and is a perfect example of why businesses and the overall economy of this country are failing. This is corporate greed at its worst.

As a side-note...our field rep stated at the time of contract signing that we should not worry if our business failed as all we need do was return our equipment and the contract would be voided. Of course he did not put this in writing. This statement was made after we explained to him that we were a small store which opened as a place of employment for our son who had suffered a traumatic brain injury, and that we were providing jobs for several other disabled people so they could feel productive and whole. We also informed him that we were desperately close to failing financially and having to close the store. What compassion and humanity is being displayed by TMG and LFG!!
