As the whole world knows, Lee County, Florida is leading the nation in foreclosures. The cities in Lee County that are experiencing the highest foreclosure rate are Cape Coral and Lehigh Acres. According to the latest statistics, something like 1 in 86 homes in Lee County are in the foreclosure process, and not much is being done to fix the leak in the dam.

Of course, with every crisis, there will be scam artists who will try to make money from the less fortunate, and there will be those that try to stop the scam artists. The Florida Attorney General, Bill McCollum, recently filed a lawsuit against a business in Clearwater, Florida for the use of unfair and deceptive practices against the public. The company named Law & Associates, LLC was sending out direct mail solicitations to Floridians who were going through the foreclosure process. The company offered foreclosure consulting services, but charged a large up front fee for those services, never followed through on the services, and failed to return monies despite a money back guarantee.

This scam involves the company monitoring the public records for foreclosure filings. Once they obtain the names and addresses of the individuals being foreclosed upon, Law & Associates, LLC immediately starts a direct mail campaign aimed at getting the homeowner to pay the consulting fee. (Interestingly, a search of the Florida Bars website reveals that that there is no known member of the Florida Bar listed as Thomas E. Law, II., so it appears this guy is not an attorney, yet is trying to capitalize on his last name and give the appearance of having the ability to do what he states).

Either way, the distressed homeowner is told that they have 72 hours to contact the company and when they do contact the company, they are told that they are eligible for the program, but they have to come up with a consulting fee of $1,500 to $2,000 for the company to take their case.

If the distressed homeowners can come up with the funds, then they must sign a contract which pretty much waives the consumers rights to have their money back. To realize the impact of this strategy, you have to realize the vulnerability of the distressed homeowners. These are good people who are desperate to save their homes, and they have probably been around the block several times with their lenders trying to get the mortgage modified or had their payments sent back to them for one reason or another, and they just want some relief.

Has anyone had trouble with law & associates,llc in Clearwater,FL?
I have paid them and they have yet to do anything for me. They haven't even contacted

my lender. I wrote them a letter to refund the money I gave them on the basis of

misleading & no doing what i paid them for. if anyone has been dealing with them

please let me know your outcome. All I want is my money back.any advice would be

appreciated.What are the chances that I'll get my money back?

Florida Sues 'Foreclosure Services' Firm


A Florida firm is in big trouble following allegations that it preys on foreclosure

victims.

Law & Associates LLC., of Clearwater, FL, was sued last Thursday by Florida Attorney

General Bill McCollum. The suit contains six counts under the states Deceptive and

Unfair Trade Practices Act.

McCollum wants the business shuttered. He also is seeking penalties of $10,000 per

violation and restitution to consumers.

Also listed as a defendant is the companys "sole managing member" Thomas E. Law II.

According to the complaint, Law & Associates sent notices to delinquent homeowners

throughout the country, promising to help them stave off foreclosure. These mailers

listed "an account number," falsely suggesting that Law & Associates had a business

relationship with the homeowner, the complaint alleges.

"You must call             1-800-329-9973 begin_of_the_skype_highlighting            1-800-329-9973      end_of_the_skype_highlighting       within 72 hours to see if your

eligible to take advantage of one of the workout options described below which may

stop the foreclosure process," one letter states, the complaint continues.

Those who called were told they had to pay upfront-from $1,500 to $2,000-before the

"mitigation process" would start, the complaint adds. They were never told that

repayment plans must be individually negotiated with lenders, the papers state.

These victims received "no services," or inadequate ones, the complaint continues.

In addition, the firm failed to honor a money back guarantee, the complaint alleges.

In some cases, it advised consumers simply to file bankruptcy, it notes.

McCollums office said it had received 65 complaints, most from 2006 and 2007.

"More citizens in Florida are facing the very real possibility of losing their homes

to foreclosure than anywhere else in the country," said McCollum in a statement.

"I don't know where to turn. My husband got us involved with housingrecovery in July and we have been trying to get a refund back since then. Anthony started talking to a Matt, and I called to cancel any dealings he had with the company and they went ahead and took money (a large sum of money) which we needed, in spite of my canceling. They did NOTHING for us. They did however, give us the run around for weeks promising my husband a refund.

He felt desperate and turned to them and now we are out 1500$ I will report housingrecovery to the internet scam department. If there is someone out there who knows where else I should go, then please let me know via this site."

Eileen, we already went over your file. If you would have told us the truth you would have been singing our praises. As far as the lawsuit you are claiming, we are being sued by none of our clients. Tom is a liar . First of all lets clear something up LAW AND ASSOCIATES IS NOT A MEMBER OF THE BBB. I am not surprised that Robert sticks up for him. Another pin head. They scammed us out of 1500.00 which my Atty is handling. I gurantee we will get that back. A few others I know are involved in a suit against them hopefully that idiot will loose his business. Anyone who can prey on someone in this type of situation is nothing but a lowlife.
