I contacted this guy & his store for a 300cc trike back in June 2011.  I paid him over $4000 for this trike.  He repeatedly lied to me about when it was to be delivered.  First it was the color that I wanted was not in stock but should arrive the next week.  Then it was that the bike was dropped.  Then the week after UPS dropped the trike.  Finally, when the trike got shipped out to me and the carrier SAIA dropped the bike, i refused the shipment and sent it back to be fixed.  The creep got the check or his affiliate that he claims to do business with or own cashed it and never sent out the bike back to me!  I received the original title to the bike (which i still have).  After repeated attempts to get Tom Spears to settle with me out of court, he then tries to blame this whole incident on the Ice Bear company and pretends to sue them, per his email:  

I Thomas W Spiers in a law suit against Pacfic Rim AKA  Ice Bear My Attorney John Vargas LAW. if and when we are awarded a settlmet I will PAY Ebony Morris the sum of 4,200 Hundred Dollars.

Well needless to say this was just a tactic to stall me from sueing him in court.  so i did.  I want Tom to know that, he was sued, i did win and he owes me $4500 awarded by the court in the State of Texas.  He was given time to appeal the decision or comply.  It has now been 1 year and i am filing a petition for a writ of execution that will garnish his wages and other rememdies in the California court system via federal court due to the fact that I am in Texas and this matter involves state to state legislation. 
 
TOM:
You were sued in 2013 by me and a judgment of 4500 was entered in my favor for you breaking our contractual agreement on the purchase of a 2011 trike.  This is your first notice of intent to collect by all remedies sought by the Texas and California law. You have 30 days to respond with payment of said judgment before I launch proceeding to California post judgment relief which can include but not limited to seizure of all real and personal property, bank levy, wage garnishment of both company of private holdings and public auctions of inventory to be held by the Sheriff's department until said judgment has been satisfied.  You have failed to comply within 1 year of said judgment.
