Tony Valencia & Valencia's Grading Service ripoff you have my dough now where is the dirt? West Palm Beach Florida

Contracted Tony from Valencia's Grading Service to deliver me 200 truck loads of fill. 150 loads of type 1 house pad fill to build a pad 100x100x6 feet high, and 50 loads of type 3 fill to raise area around the pad.

Originally Tony quoted me a price of $55 for type 1 & $50 for type 2,said it would take him 2 weeks, because he can only do 20 loads a day, and he only had 1 truck.

Now the company was building my house pad said he could have all the dirt delivered in 1 week @ $65 per load and would charge me $1,000 to grade it.

I told him I was able to save myself over $2000 by using another company, only problem it would take 2 weeks for the other company to deliver. He said he could not keep his Machine tide up for 2 weeks for only $1,000.

Talked to Tony he said he can do it in 1 week would get 2 other truckers to help him out and it would cost me an additional $750 $5 x 150 of the type 1 material left the price of type 3 alone.

1st week delivered 40 loads, second week appox 60 loads (his claim) then the rain started and it all went down hill after that. 2 weeks went to 3, 3 went to 4, 4 went to 5 and on week 6 I got tired of his excuses. and fired him from the job.

Now so far it seems like NO BIG DEAL right? wrong.

I live 1 hour away from the job site so to avoid going back and forth I prepaid for all the loads, $11,500. So he had all my money already, My grading contractor had to go to another job in the middle of week 2 and said it would cost me an additional $300 to go back and forth. With all tre rain, the ramp became impossible for the trucks to climb the house pad so Tony decided to dump dirt everywhere but my house pad. The Grading guy wanted extra $200 to move it Tony agreed he would pay it. After I fired Tony on week 6 the county came in and cleared the swail in front of my house, leaving me to build a temporary culvert so I can get the rest of my dirt on my lot.

Now Tony offered to give me back $420 for what he felt he owed me. But based on my calculations he owes me the following:

Based on his calculations he delivered 164 loads of type 1 fill and 20 loads of type 3.

My house pad is still not at elevation yet after i fired him leaving me to believe he did not deliver what he claims he did. I am about 20 loads short based on my Grading guys calculations.

Not only did Tony cost me extra money because of his delays, he even ripped me off about 40-50 truck loads of dirt.

By the time I add up the extra cost for the grading guy, culvert and dirt he did not deliver, I got taken for over $4,000.

This goes to show you try to help a little guy out and they end up screwing you.

His song and dance about all the rain this and that, he could have taken 2 weeks to complete it and the rain wouldn't have affected him, instead I believe he was delivering loads to other customers as well as my lot.

By the time I am finished with Tony from Valencia's Grading Service, he will have to relocate his business. Rip Off report is my first stop but not my final stop. BBB is next, Consumer Affairs, Help Me Howard, if anybody has any ideas of how I can get my money I would appreciate it, Small claims in another avenue I'll look into. But that could take months, need a quick fix.
