In 2001 I bought a USED Nissan Xterra for my daughter, she was paying for it. At the dealership that day, they had me give them 2 post dated checks, totalling $7,000 for a down payment, which took me almost a year to pay off. We never got credit for the money. I asked for the checks back, and checked into it, and it was against the law for them to even hold checks like that. My daughter paid $526.43 per month. 2004 rolls around, which means she has paid over $25,000 on a vehicle that wasnt worth $20,000 brand new. I lost my job in June 2004, and Angie broke her hip, was out of work, but I borrowed $1,600 from a friend and sent to Transouth in January 2005.
They had a habit of never giving us proper credit. Angie did not live with me at that time so I was unaware of how the account was being handled. It turns out they were harrassing her constantly, adding on this fee and that fee, etc. She went back to work but died in March 2005, at age 29, from a blood clot. During this time I was completely devastated. I did not know the Xterra had even been repossessed until a member of my family told me they had picked it up from where Angie had been living. If I had known I would have tried to work out something after all the money we lost. These companies are a complete rip off! Now, CitiFinancial has hired a third party, Mann Bracken, LLC, 209 10th Ave., Nashville, TN 37203, atty. Nicholas H. Adler (615) 296-9337 and has summoned me to Civil Court for $7,5222.75. Not only can I not pay this, I dont feel I should have too.
I wasnt notified or given a chance to keep the vehicle, and after losing my child made it that much more horrible. I am a good person and they have also left on my credit report that my original loan was $36,000 (for a USED vehicle) and no explanation of payments or anything. If Angie had been so behind, wouldnt they have taken the vehicle long before 4 years had passed? I need an attorney to help me because I would love to counter sue for being ripped off and for harrassment to me and my daughter that ended up in her loosing her life. I am not gainfully employed because I suffer from depression and anxiety. I have worked for 30 years so I am not just pretending so I wont have to work. I have to support myself. Any help would be greatly appreciated.

LVNV and MANN BRACKEN are some of the worst junk debt buyers and violate Federal collection laws regularly.
You can find an attorney through this site as well.
File formal complaints against the original creditor with the Federal Trade Commission and Office of Thrift Supervision as well. Not applying payments is a violation of the FAIR CREDIT BILLING ACT

Connie, I am so sorry for your loss. Look up your local Bar phone number. Your local Bar Association should be able to refer you for some legal aid. And remember, they have to prove that you owe this money. I hope this advice isn't too late. Mann-Bracken is considered to be one of the worst.

I am very sorry for your loss, Connie. You need to find proof of every payment you made and the original contract in order to fight this. Do you actually know that your daughter made every single payment on time? You need copies of those payments too. It sounds like between the two of you, you didn't know what was going on with the account so there was confusion. Unless you have all this proof, I doubt you can counter sue for anything. It is sad that your daughter died but they didn't have anything to do with her death or anything. Also, get some therapy and meds if needed so you can get back to work and take care of things.
