Triad Financial - Road Loans ripoff misapplied payments missing payments fraudulent billing violations of FDCPA Huntington Beach California

I have had a loan with Triad Financial since October of 2003 and I have had so many misapplied payments, missing payments, and payments posted long after they have cleared my bank account, that my 5 year loan has turned into a 7 year loan.

Triad has on numerous occasions taken a payment from me by phone, and then not applied it untill days after it has cleared my bank account. Also, any time I have mailed in a payment they take even longer to apply the pymt- sometimes it will be weeks before the pymt is actually applied to my account.

On occassion when my account has fallen past due, Triad representatives will call several times a day, leaving messages each time, which is a clear violation of the FDCPA, not to mention the fact that thay call before 8am and well after 9pm- also a violation of FDCPA guidelines.

They have also been asked on several occassions not to contact me at my place of employment, and I have written 3 letters to this effect, yet ever time my account become more than one day past due, I will receive a call at work.

I have also asked Triad reps repeatedly not to call my "references" yet they continue to call and harrass family members, friends, and neighbors.
