Tropical Flurry LLC, Tropical Flurry LP, IAF Beverage, Ice Age Frost Beverage Scam, I paid $160K for machines and territory. Did not receive machines. Territory would not allow products in the state. Products did not meet USDA regulations as touted. Dallas Texas

I paid $160,000 for a Tropical Flurry franchise which included territory in Alabama and Georgia.  It also included 44 slush machines.  The products were 100% fruit concentrate and milk based cappucinno and smoothie's.  Tropical Fluryy, Jack Level said the products would replace a dairy item for the milke based products if sold in the school lunch rooms.  The fruit based products claimed to replace a cup of fruit or vegetable in the lunch room and the school would be reimbursed by USDA. 

I did not receive my machines.  The state of Alabama denied the Tropical  Flurry products access to the schools because they did not meet USDA and Alabama standards. 

Jack Level has editied emails from USDA staff claiming his products meet these requirements.  My suggestion is to contact the USDA with a copy of the product label to see if it meets guidelines.

The fruit concentate and the milk based products are 100% imported from China.  They are processed and bottled in Texas.  The USDA is required to instruct schools to ask for a Certificate of Origin to prove the product and the processing is a US product.  Tropical Flurry can not provide this information on their fruit and milk based products.  The Certificate of Origin is required to sell products a-la-carte and on the service line in school lunch rooms.  Jack Level will tell you juice products do not need this certificate.  Ask USDA what the requirements are.

Jack Level and crew have been sued dozens of times in civil courts.  Jack does not draw a salary and his family members own the company.  He has little to nothing in his name and civil judgements are useless as you will not collect on your judgement.

I have spoken with a couple dozen victims that have lost all of their investment with Jack Level and his list of companies. 

Franchisors are required to provide the following information to all potential investors.  Jack Level did not provide any of the following.

1. List of all former franchisee's with contact information.  Jack provides a list of a few current franchisee's but not the complete list as required.

2. Litgation history of all principals in the company is required.  Jack did not provide any of this even though there are many cases on the court records.

3. Audited financials are required on the company.  Jack refuses to provide audited financials.

Summary, I lost my $160,000 to Jack Level and Tropical Flurry and/or IAF Beverage.  I would not do business with this company or individual.
