Do not do business with this company

I began to work with manufacturing and fulfilment comapny, Tropical Products and Ed Berman in July of 2014. He gave me the list of my ingredients that did not include glycerin, among other things, per my company’s instruction to him for our products. He had instructed me to have the sales rep for the flavor company to call him to discuss my ingredients and collaborate with the proper sweetener and other ingredients to make the product work. I had suspicions when the flavor rep and Mr. Berman would not answer my questions in regards to their conversation.

Mr. Berman comes off as so honest, so caring, so nice and so helpful, however I did notice he gave a bit too much information about other products he was producing for other companies. I shipped him the flavors to add to the ingredients for testing. It took 8 weeks to get the complete flavors to him. He had held our products until ready for testing. 3 months later we tell him we are ready. He asks me to send him all confidential information to begin formulation. 5 days later he tells us that he is selling his company, but staying on another year and that they will no longer be producing this product because of the strict FDA regulations coming forth. I already told him of these changes 4 months prior and that our company was to undergo the testing. However, the FDA will not be making these changes if the product does not make claims.

Ed Berman so gently and nicely said that he will be happy to send my flavors back to my company. It is written in our NDA that this is our company’s property and he is to return the flavors. BUT, after 30 phone calls and emails to ask for the return our property, he refused to answer. He refused to return our property. 1 month ago, I spoke with the secretary who asked for my email and that she would find the answer for me that day. I sent her my email while we were on the phone to make sure she had it. She said she received it, relayed me email address back to me and we hung up. She never responded. Why? We found out through the flavor company that his discussion with the flavor rep was to put glycerin in my flavors so Mr. Berman would not be responsible for the glycerin in the base ingredients. I had already prior to this forwarded to the lab technician the base ingredients that Mr. Berman and our company discussed and he forwarded to me. The flavor company was confused as to why they sent the products with glycerin. Now we know. The flavor rep is gone and this report has been written. Now the flavors have been produced properly without sinister acts from a sinister man and company.

"We are the entity who had to educate Ed Berman & Tropical Products on FDA regulations." Really?? FYI: my company has been FDA registered for over 15 years and we use U.L. (Underwriters Labs) as our FDA consultants, not an "unnamed entity" who posts anonymously. Entity, what is your name and why won't you indentify yourself? I do not recall ever using any other consultant other than U.L. You are a "certifiable" nutcase. Crawl back into your hole and obsess over someone else who you percieve as having wronged you. I'm sure there are many. There usually is with people like you, this irrisponsible forum is rife with them. Ed Berman, Tropical Products, Inc.

There is a major personal lubricant company who jumped ship from Tropical Products because they are not compliant for medical device manufacturing. We don't want to name drop, but will if there is another false report written by Ed Berman, it will surface in bold writing.

Tropical Products is NOT compliant with the Code of Federal Regulations or ISO certified to manufacture medical devices. FDA's Center for Devices and Radiological Health is responsible for regulating firms who manufacture medical devices. He is not registered. He is not compliant. This takes an expensive overhaul of his manufacturing and regular reporting. He needs to know the difference between compliance of medical devices vs. cosmetic products (which he is compliant for). If he does not know the difference, this is dangerous practice. This is why we were not able to do business with Tropical Products. Mr. Berman informed us that he was only going to proceed to manufacture hair color and aerosols. He mentioned that he is a staunch Republican and will not allow any more government interference than what he is already experiencing with cosmetic products. In addition, the expense is more than he could handle.

We set up businesses and sell them. We comply with all regulations or we would not be able to sell products.

The Ripoff Report is aware that there are no other reports filed. No reports were filed against the flavor company. They fixed the sinister act by Mr. Berman. All someone has to do is ask him the name of the company, type in search and nothing will return in the results.

How do all of his fairytales justify sinister acts and theft? It’s a smokescreen.

One certifiable nutcase

We stand by our original rebuttal. This person is not even in business and has no clue about FDA regulations. If she were, she would know that all personal lubes are now considored "medical devices" by the FDA, all of them. This is one "certifiable" nut case. Unfortunatly, they are out there. Ed Berman, Tropical Products, Inc.

There was no complaint filed in regards to the flavor company. They actually tried to rectify the problem by creating a solution. They did. They did a great job and we thank them, however we decided to sell. 

Mr. Berman's potential investors had informed him that they would have nothing to do with personal lubricants because of the FDA's intrusion and strict guidelines coming forth December 2015. Mr. Berman's facility is not set up by FDA (510k) medical device standards and guidelines which is costly, therfore his argument makes no sense that we would not comply because he isn't FDA compliant!! His facility is unable to manufacture per the guidelines of the FDA. I love this when this happens......

We are the entity who had to educate Ed Berman on the upcoming FDA regulations. We have a direct phone line to the person in charge of review products at the FDA and we mentioned to him where and from whom the information was coming from. The original report is very detailed and everything that is written in the original report is in a file including phone calls, emails, etc…. There is no anger. It is the behavior pattern by Mr. Berman mentioned in the original report that is disturbing. These reports are written to help others to not find themselves in these potentially serious situations. There are many companies who left ship on Tropical Products a while back and not so certain the some of the companies he mentioned are on board with them. This rebuttal is written by him because he is trying to sell his company. Period. Our company has complied with all FDA regulations and sold our marketing concept and formulas to another company thereafter.

Disturbing complaint

My name is Ed Berman and I am President of Tropical Products, Inc. in Salem, Ma. I was very disturbed to read this complaint against me and my company by an "anonymous" person.

The fact that this was penned by an "anonymous" source, a person who doesn't have the courage to identify themselves is a "giveaway" that maybe this complaint is without merrit.

The person who made this complaint is named Renee Castillo. She is attempting to start a company called "Pink Oyster". Ms. Castillo wanted my company to develope a line of flavored personal lunbricants for her. The problem is that these products are considored medical devices by the FDA. These are very stringent guidelines that Ms. Castillo did not want to follow. This is illegal and unethical. We did not want anything to do with her or her company and she was angry. Hence the complaint.

It is concerning that sites such as this one will publish unsubstantiated, irrisponsible and damaging complaints without checking the validity. 

My company, Tropical Products is an FDA and EPA registered manufacturer. Our customers include companies such as Wal-Mart, Target, CVS, Bath & Body, Yankee Candle, Petco, Bed-Bath & Beyond, Amazon, to name a few. We will not put our reputation on the line for someone like Ms. Castillo.

And, for the record, she made a similar compaint against the flavor manufacturer and a bottle manufacturer. There is a patern here.
