Troy Davis Truck Sales Waiting for my refund of $32,500 after a year!!! Bad Communication and Empty Promises from Owner Eastland Texas

I am in tears and in complete shock and disgusted with the many lies in Troy Davis’s response. Troy Davis had said verbatim that he gave me his word that he would refund my money and now with this response it looks like he will try to lie his way into keeping my money. He has already refunded only $10,000 of the $42,500 and now he will not respond to my attempts to reach him. I have every single document as proof and text messages that reflect all agreements. There are several things wrong with his response and attempt to keep our money. 

First, the only invoice we ever received was one invoice of 6. I would not be surprised if he try to make up new ones that I had never seen just to cover himself. Regardless, there are no signed contracts for the 24 trucks and this deposit that he speaks of. 

Second, we did pay the invoice over several wire transfers within a span of a month (First payment July 2nd and last payment on August 4th), but never nearly as exaggerated as he tried to make it seem. I have all correspondence. If he had an issue with several payments, then he should have been upfront by saying that Troy Davis Inc would not be able to fulfill the order if it was paid over couple payments. Additionally, once Troy Davis received the money and realized that the trucks could not be delivered then they should have refunded right away or made us aware. I have many emails showing our attempt to reach him trying to figure out where our trucks were. He never responded or sent emails demanding more money after the invoice of 6 was paid. If it was an issue of us buying more trucks, then he would have sent invoices or emails requesting payment but he wasn’t able to fulfill the 6 we purchased so that was the reason he ceased communication.  

His arguments do not make sense because Troy Davis said we paid for 5 trucks and a deposit. That is incorrect. The 1st invoice was for 6 trucks at $42,500 each delivered for the total invoice cost $255,000.00 USD. Nothing in that invoice said anything about a deposit and it was never mentioned to us about any deposits. We were interested not committed in purchasing 24 trucks but at 6 at a time. The first 6 was a complete nightmare and we were missing one truck so there was NO WAY we would purchase more trucks from this business.

Also, in any of the correspondence why did Troy Davis Inc completely ignored phone calls and emails if he was demanding more money for the rest of the trucks? It doesn’t make sense. He couldn’t provide the last truck and that was why he never answer us and now that we want our money back he is trying to lie his way into keeping it. There was no talk of deposit until after we demanded a refund. I can’t see how a company can steal consumer’s money and get away with it. This has been the worse experience I have ever encountered with a business. Troy Davis Inc.’s response complains about us paying our invoice over a span of one month yet he hasn’t refunded our money in over a year!!! Awful company.

Michael Ninh owner and Jimmy Redman associate of Ninh Truck purchased 24 trucks from Troy Davis Inc that was to be shipped to Vietnam. Troy Davis, Inc. had a contract agreement and was obligated to pay for 24 trucks that Michael Ninh ordered. There were 4 invoices for the 24 trucks @ 6 trucks per invoice. Ninh truck only paid for 5 trucks.

The 5 trucks were paid for at random and Troy Davis Inc had to seek those payments out. The only other payment Troy Davis, Inc. received from Ninh truck was a deposit on all 24 trucks that was non-refundable. That amount was NOT $42,500.00. Troy Davis, Inc. could not deliver the last truck because again payment was received at random. Our drivers had already made several round trips. The price agreed upon at $42,500 per truck including delivery was for the trucks to be all paid for and delivered together. Not random payments and individual trips made by our drivers. Troy Davis, Inc. does not deliver trucks that have not been paid for.

Troy Davis, Inc. received financial loss due to Ninh Truck only paying for 5 of the 24 trucks Michael Ninh ordered. The information provided on this report is false and inaccurate. Troy Davis, Inc. remained in constant contact with Ninh Truck and has all records on file pertaining to this case.
