Trucks Only - Sullivan Investments rip-off royally Mesa Arizona

We have a truck financed thru HSBC. When we started to fall behind on our payments the bank offered us a settlement agreement if we could get someone to take the truck for $14,500.00.

On 2/4/2005 Trucks Only (Sullivan Investments) offered to take it in trade and get us into a vehicle with a much lower payment something that we could afford. They put us into a 1999 Ford ExplorerVIN 1FMZU34X4UC39935, they took our trade and sent us home in it that night.

18 days later they called us and told us we had to come down and restructure the loan or deal, from what I hear their suppose to let you in 3 to5 days if they can't get you financed(our truck payment were now getting seriously delinquent)that's when they told us they could not get us financed.

So we asked for our trade and down payment back, a 2004 dodge Dakota. They did not give us our down payment back right away, and they weren't going to give us our trade-in back right away, but one of the salesmen went to the back lot and got it right away for us (I guess he felt a little guilty) when I went over to inspect the truck, I found out they had detailed and had it on their lot.

I drove by and seen it there on their lot. First thing I noticed when I opened the door was the factory floor mats were missing. Then I looked down into the door jamb and found out that they had scrapped off the BORN ON STICKER you know the sticker that contains the VIN, the date of manufacture, vehicle weight, etc I hear this is a crime to remove it. There was also other damage to the truck, from when they detailed it such as the missing antenna.

We did have Glendale police come down and do an incident report before we removed the truck from the lot. They caused my wife to have a bad anxiety and asthma attack to were the paramedics and firemen needed to be called. That night created my stress and anxiety levels to rise way above normal, which forced to go to the E.R. a day later my stress levels had not returned to normal because of this to were I need to seek professional help. Then to make things worse they forced us to drive the truck home with no plates or insurance, I probably have more to say on this matter but that jist of it

Then they replied with a pack of lies to the Arizona Attorney General and the BBB.I wished I could scan their letter in but I don't have a scanner, But from my response back you can just guess what they wrote, Here is my response back to the BBB

Dear Ms. Callaghan,
In response to Mr. Di Lascioi, response to our complaint, I have the following to write,

First off in my original letter of complaint I did not conceal the fact that we were behind on our payments with HSBC, and according to HSBC (the bank with the loan on this truck) this was NOT TO BE A TRADE but a purchase between Trucks Only and HSBC (the bank), and yes we were pleased to be having a new lower monthly payment.

In so-far as this Marty proposing a larger down payment, that was a down right, (and I hate to say this), LIE, this is one of many that Mr. Di Lascio has written in his response to our complaint, had they offered a larger down I might have taken it but no offer was made.

As far as Mr. Di Lascio saying he went to the back to personally pick-up the truck is another lie. The salesman in this deal went to the back to get our truck his name is Steve and he pulled it along side the building and parked it that's when I (Dirk Eberle) not my wife Jayna went up to it and, started to see all the damage that they had done to it such as the missing floor mats and the born-on sticker.

I am an ASC Certified Tech and have a degree in automotive and have worked in the industry so I know it is a crime to remove these stickers and that's how I (Dirk Eberle) not my wife Jayna, happens to know the name of these stickers, and that when I (Mr. Eberle) pulled it along side the Explorer, so we could get our stuff out of it. There was no mention of a lawsuit until Mr. Di Lascio refused to return our property, or fix the damage that had been done to the truck, as far as I know their not even suppose to touch the vehicle until the financing has been secured, so as far as them driving it 3 miles and detailing it, I (Mr. E) did not authorize it

As far as anyone calling the Police goe's it was I (Mr. E) who told my wife to go and call the Police because that truck was not leaving their (TRUCKS ONLY) lot until a Police report was done showing that the workers of TRUCKS ONLY had removed the V.I.N. stickers because since I (Mr. E) an ASC Certified Tech knew that this would have to be done so I could have proof that they removed the stickers and not I (Mr. E) which the officer writing down the incident said that it's a crime to remove these stickers I have pictures of the damage.

Now as far as my wife's asthma attack goe's she asked Mr. Di Lascio to get out of her face which he refused to do, she has had asthma for years do I need to get her medical records for Mr. Di Lascio so we can prove it was not staged. So since Mr. Di Lascioi would not get out of my wife's face he induced not an asthma attack but an anxiety attack which after the firemen and paramedics showed up they confirmed this fact, should I get the reports from that night to prove this to Mr. Di Lascio. She did not force a cough or hacking and it was the officer that night who asked me (Mr. E) if I wanted them to call the paramedics to the scene to which I (Mr. Eberle) answered yes, the reason they did not take her to the hospital, because she declined to go because after they got Mr. Di Lascio out of her face she began to calm down and none of this was staged, shall I (Mr. E) get the police and fire reports from that night for Mr. Di Lascio so he also can see that none of this has been staged, also since that night my (Mr. Eberle) stress and anxiety have gotten to the point to were I (Mr. E) have had to go to the E.R. for high levels of stress and have been put on medication for the same.

All this caused by TRUCKS ONLY and Mr. Di Lascio, so if Mr. Di Lascio doe's not retract these remarks and apologize I will seek an attorney and go for slander and defamation of character. I am quite sure that the police and paramedics have the report of that night, its sad that it may have to go that far but, I am willing to pursue this matter as far as I need to go with it.

If TRUCKS ONLY did detail our truck it, was without my authorization, and I would have to assume that's when all the damage was done to the vehicle, you have to remember this was all done without my authorization, and also it is no 3 miles to their back lot where they said they had only taken it to, shall I (Mr. E) go down there with a tape measure and do the measurements to prove this point so why were there 3 miles driven on this our truck, and also why did it have a lot number sticker, (STOCK NUMBER) on it if they were not trying to sell before the financing was done, I (Mr. E) still have the lot sticker, (STOCK NUMBER) that they had put on it, do I (Mr. E) need to show this to Mr. Di Lascio to refresh his memory. And it was Mr. DI Lascio who forced us to drive home, about 15 miles, without insurance or a license plate.

And it was I (Mr Eberle) who had seen that they had scrapped off the born-on sticker and since I am an ASC Certified automotive tech I do know the name of this sticker, so this is just another lie that Mr. Di Lascio has made about that night since it was I (Mr. E) who noticed the sticker being scrapped off and not my wife. And if my check did bounce it was because I (Mr. Eberle) did not get to the bank on time to put the funds in it, and besides what bearing doe's that have on this case, none what so ever other than Mr. Di Lascio has a need to grasp at straws

What would bring this to a satisfactory close would be for Mr Di Lascio and TRUCKS ONLY to admit to wrong doing and payout the correct restitution in this matter, as I am now willing to do whatever it takes to resolve this matter to my satisfaction.
