We want to report about bad business practice conducted by Tyco Health Care, specifically, Doug Smith.
In July 2003. We started the projects to expand the medical equipment selling markets in China to help US economy. Tyco Health Care was one of the companies we had contacted for our potential end users. In August, we obtained the quotations from Tyco Health Care. At the same time, Tyco Health Care introduced us to their representative--- Insight Medical---in our area.
We put a lot of energy, money, and time in the projects. We have obtained extended quotations, and have been always assured that we will get order delivered without any problem from their representative.
The current end user was Tyco Health Care authorized end users since they had purchased their systems before. Now they need consumer able parts from Tyco Health Care. Without these parts, the expensive system they purchased from Tyco Health care is useless.
After talked with their representative, and got her assurance for delivery again, We have signed contract with the end user. We have placed the order in Feb. 2004 partially. Our order has been confirmed and delivery date was told. But products were never shipped.
Later we received a letter from Doug Smith stated that he will only sell their products to authorized end users. We explained to him their products were going to an authorized end users, but with no reason, he refused to sell the products without considering those suffering patients with very rude manners.
Can a company does this: providing the quotations to a customer; pushing for orders; receiving an order; confirmed the order; setting the delivery date; then later, the order has been refused!
Can a company sell an expensive system to a customer and later refuse to sell them consumer able parts so the expensive system has no use?
What about those patients who are waiting for the surgeries and surgeons do not have consumer able parts and cannot perform the surgeries?
What about the loses of our company, who spend a lot of time, energy, money?
What about we could not deliver the parts that we signed contract with the end user, now we are getting penalized?
We received an apology email from their representative said: I am embarrassed and ashamed that the company agreed to assist you and then after you had been waiting for three week would not assist you. As I said to my Regional Sales Manager, Dawn Donatoni, all I have in this business is my integrity to do what I say I am going to do. Radionics( under Tyco Health care) said they would ship you the product and then did not deliver on this agreement..
Please publish our report. We believe this is a fair world. Unfair treat others should be penalized one way the other.
Please help those waiting, suffering patients.
