Hello All.
I received a summons for court from an attorney representing Unifund CCR Partners assignee of Palisades collection LLC

I never received anythign from either of those companies before the summons. Anyhow, the summons stated I had 30 days to respond. I did a quick search if the net and found I had 2 options- Ask to settle or fight. I chose to ask to settle. I wrote my response confirming I had an account witht he original credit card company and would like to the court case stopped and to negotiate with Unifund directly. I received a letter back from the attorney who told me since I raised no legal defense, they wanted the court to rule in their favor. I immediately prepared a second response stating that I wanted proof that the company legally was entitled to the debt and that I thought is was past the statute of Limitations and request for discovery and filed it with the court. The attorney now has petitioned the court to have my second response stricken because I did not receive permission to submit it and also states it contradicts the first response (It doesnt, I still agree I had the original account, I questions their legal right to collect on it). He also states that my first response admits owning the account so they should receive a default judgement.

So much for trying to handle it admirably.

So Now I am unsure how to proceed. The account was opened in MI (SOL 5 years) but I moved to SC in 2003 and it was last paid in 12/2003. SC SOL is 3 years. Which states SOL will be used if i am being sued in SC?

How do I proceed? I am not an attorney and it seems I may have damaged my cause already and dont want to do any more damage. What papers can I now file that the attorney can not try to get stricken???

Also, When I sent my second response and request for discovery, I included that they needed to provide a large ammount of documents proving they owned the debt. I received back the motion to strike but also received request for admissions from them which was asking MANY of the questions I asked for in my request for discovery. If the court strikes my second response/ request for discovery then does that mean they dont have to answer??????
