I had a collection on my credit report from Unifund. It appears that Unifund purchased a Providian Credit Card account that was charged off in 2002. I was served by the Sheriff with a Notice of Right To Have Exemptions Designated. The form says Unifund filed a judgement against me in May of 2006. I don't know what to do about this.

To anyone who has been "sued" without being properly served, be sure to file Bar Association complaints against any lawyers involved.

You can also seek criminal fraud charges, as it is a felony in most states to file a false document with the court. See your DA.

And, go to FTC.gov and file online complaints, just to create a record for future legal actions.

unifund lower then low scum suckers

I was served papers form the sheriff back in 2006.. there was no court date onthe papers.. i contacted the department of commmerce in my sate and i sugest that you do the same.. i am in contact with the court house in my home town and there is nothign there against me.. i also have heard of people that they have taken to court and unifunds attorney dont show up.. i think you should go to the court house and see if there is any thing files against you.. then i would contact the department of commerce talk to someone that deals with collection companies.. best of luck to you...let us all know how you turn out......

You need to go to the Court that issued the judgement

If you were not given a court date to appear because of these bottome feeding scum Unifund back in 2006, then you must go to the court of the judgement and tell them you were not properly served. These scammers will send notices to wrong addresses and then go to court, knowing full well they didn't properly serve the debtor and get heard from the judge. If you don't show up for court, it was assumed you did owe the debt.
