My wife and I purchased a couch at Haynes in Newport News and at that time bought a extended warranty from Uniters North America, LLC.
My wife and I purchased a couch at Haynes in Newport News(08/06/11) and at that time bought a extended warranty( Good for 5 years) from Uniters North America, LLC. Uniters North America and Haynes both have said they will not fix or replace the couch which is currently pealing. Uniters claim that bonded leather is fabric and is not covered under their warranty. If that is true why were we not told that bonded leather pealing was not covered under the warranty. We were told at the time of purchased that if the couch fell apart, as the covering is currently doing, they would fix or replace the couch. We would have never have bought this couch if we knew this type of material would do this,. The model number is 8515sspp/0501-0750 (Brand: Uniters) (Uniters Protection - 501-750). The Sales person was James Higgins and our Customer # was 104JBQ55, Store 104(Haynes) I can only assume that Uniters are the makers of this Couch and now refuse to HONOR the Warranty which was sold to protect their product.

Dear Sirs,

Our records show that Mr. Santiago filed a claim November 30th, 2015 for peeling on all seats and the left and right facing back casing of the sofa. Based on the information we received from the retailer Haynes Furniture the sofa is made of bonded. Bonded is not leather but rather a composition product that includes leather. As per the terms and conditions of the protection plan Mr. Santiago purchased, cracking and peeling on bonded leather is covered on non seating areas only. Seating areas are defined as all areas where body touches the furniture such as the seat casings, back casings and the arms. Since Mr. Santiago filed the claim for cracking and peeling on bonded in the seating areas, the claim is not serviceable under the terms and conditions of the protection plan. Please be advised that Uniters North America is not the manufacturer for the sofa. Based on the information from Haynes Furniture, the sofa was manufactured by Emerald Home Furnishing. We are attaching a copy of the terms and condition of the protection plan for your review and as such we regret to inform you that we will be unable to take any further actions on the claim.

My reply to that

I understand that cracking and peeling in seating areas on FABRIC (which now I understand to also mean "bonded leather") is not covered. This is not what I'm arguing.

I am arguing that the SALE OF THIS COUCH WAS MISLEADING AND DISHONEST. I thought I was buying a REAL LEATHER couch. I desired LEATHER for its durability. When I asked the sales associate what bonded leather was, he informed me it was a "type of leather" (i.e. not fabric). When I questioned further as to weather it was real or fake leather, he ASSURED me it was REAL LEATHER, in which case the cracking and peeling in seated areas would be covered by the warranty. I know. I read the warranty before we finalized the sale thinking I was buying a LEATHER couch. There should be a notation in the warranty that bonded leather is considered fabric and not leather.

This leads me to 2 conclusions.
1.) The sale associate either knowingly lied or was erroneous in thought. You are responsible for your sales people, no?
2.) Your advertising / warranty language is deceptive


4 years after the purchase our FAKE LEATHER couch (i.e. bonded leather / fabric) it's is falling apart. Mind you this is more than just cracking. Large 2-4 inch pieces are flaking off revealing large mustard colored holes, not to mention the cracking that covers the entire seating area. Moreover, the couch was barely sat upon until last year.

I WOULD LIKE REPLACEMENT OR COMPENSATION for this DEFECTIVE product.

I will continue to fight this until I receive a REPLACEMENT OR COMPENSATION for this DEFECTIVE product.
