My former University of Wisconsin Whitewater professor Sally Vogl-Bauer has filed a lawsuit against me for get this... $900 for my describing her as "degrading," "condescending," "demeaning," "verbally attacking," "unjust point deductions and grading," on the internet. That's according to the summons sent to me in the mail from her. The lawsuit is scheduled to be handled in September 2014.
From January 2013 until May 2013, I was enrolled in Sally Vogl-Bauer's graduate level course pursuing my master's degree education. Sally made the experience a nightmare for me, degrading me and patronizing me behind closed doors during her office hours, making comments like you don't belong in college, questioning me on where and how I got my degrees, questioning me on who all my previous professors are, lashing out at me if I couldn't name off all my previous college teachers for her, calling me a horrible student, questioning as to how I got into college, etc., etc., etc.
I spent months reporting the matters over to UW-Whitewater administration, trying to get them to take action and actually do something about my complaint to no avail. UW-Whitewater administration repeatedly refused to do anything about the matters, sending me through long runarounds, blowing me off and coldly dismissing me.
It's worth noting that at around the same time that UW-Whitewater was mishandling my complaint, they were also involved in a lawsuit matter in which the university's administration members were fouling another student as well. Unsurprisingly, it was the same UW-Whitewater administration members mishandling my complaint who were fouling this other student. These individuals are Richard Telfer, Kim Hixson, Mark McPhail, Sara Kuhl, etc. I dealt with one additional unethical and incompetent dean by the name of Greg Cook. If you want to read up on this other student's own circumstance in which UW-Whitewater administration fouled her, just look for newspaper articles from the GazetteXtra titled "Student Editor Faces Legal Exposure" and "Our Views: UW-Whitewater acting too late to help a student editor."
In trying to report Sally Vogl-Bauer's misconduct to the college, UW-Whitewater administration did nothing beyond show biases for the professor. For example, they repeatedly responded to my complaints with irrelevant statements of praise about Ms. Vogl-Bauer's reputation; telling me they'd never received complaints of this nature before and thus I was dismissed, and they weren't taking any action; etc. I even sent them e-mails from an entirely different student who was enrolled in Ms. Vogl-Bauer's course who described Sally as "teasing her, picking on her, ridiculing her and showing no remorse." Of course, they blew off those e-mails as well.
Finally, I went beyond the university to get my complaint resolved. I first turned the matter over to the Better Business Bureau. After the BBB's own involvement with the university for well over a month, they ended up issuing a strike against UW-Whitewater as they felt the university didn't make an ethical attempt to resolve my complaint matter. Included with this, I exposed Sally's treatment of me and the university's unwillingness to do anything about my complaint online so that everyone could be made fully aware of how this professor and college does business.
In November 2013, I received an e-mail from a lawyer representing Ms. Vogl-Bauer. The lawyer informed me that my online complaint "threatened Sally Vogl-Bauer's life," and thus, she and this lawyer were reporting me to authorities—that my complaints needed to come down immediately for this reason. In response, I called the lawyer on his garbage, stating that the online complaint in question would be hard evidence that the two of them are lying, that it's clear I've done nothing beyond report Sally's mistreatment of myself. I informed the lawyer that he and Ms. Vogl-Bauer were in effect slandering me by spreading such falsehoods to authorities and that this is illegal. The lawyer was quick to apologize for this and urged me to consider it an understandable mistake.
Following that, the lawyer began to focus on how my online complaints still needed to come down because they're "disparaging" to Sally Vogl-Bauer and that if they didn't, legal action would follow. I told the lawyer that I'd be happy to remove my online complaints about Sally if she and the university agreed to do something to make up for all the misconduct and wasted time. Immediately, he refused and so I dismissed him.
In late December while preparing for Christmas and caring for my handicapped brother, I received a summons informing me that I am being sued for $900 plus all court costs for online statements I made about Sally Vogl-Bauer, citing get this... that I described the teacher as "degrading," "demeaning," "verbally attacking," "condescending," "lashing out," on the Internet. Everyone I've spoken to believes the lawsuit is complete and total garbage and will be thrown out.
Sally and her lawyer have paid for a jury trial which is unconventional for small claims cases. I did some online research and according to legal experts, "Some lawyers who believe cases will be thrown out by a judge, will try to be slick and elect for a jury trial as jury members are randomly selected individuals less experienced in law." According to online legal information I looked up, the side who pays for the jury trial gets to elect the jury members.
The court has asked us how much time we need to prepare for this case and while I have stated 0 days as I'm ready to get this case handled, Sally and her lawyer have requested 90 days to put together a case. Topping that off, Sally's lawyer has been harassing me, sending letters to my place of residence, demanding that I release to him all of the evidence that I will be using to support myself in court; demanding that I release to him a bunch of irrelevant information about my background that has absolutely nothing to do with this case, such as my legal history; demanding that I release personal information of "every single person" I've spoken to about this teacher (their home addresses, telephone numbers, names, etc.) When I refused, the lawyer sent a letter threatening that he'd be seeking an additional $1000 dollars out of me.
For any professor to try to muzzle a student's right to free speech like this is I believe is detrimental to all students. No telling who's next. What Sally Vogl-Bauer and UW-Whitewater administration have pulled is beyond unethical. Avoid this teacher and college at all costs. I have been strongly encouraged by multiple individuals to pursue a counterclaim against the professor and the lawyer for false reports made against me to get this teacher reviews down (which I have an apology from the lawyer for), harassment, malicious prosecution and pain and suffering.
When I informed UW-Whitewater of this outrageous lawsuit by this teacher, Sara Kuhl responded that the college refused to take any action with regards to the matter and that Sally's complaint against me is her business. Mind you, had UW-Whitewater administration actually done something about my complaint in the first place instead of completely allowing this teacher to get away with her offensive behaviors, I wouldn't continue to be plagued by this teacher. Folks, there you have it. That's what kind of university UW-Whitewater is. Get involved with the University of Wisconsin-Whitewater at your own peril.
P.S. UW-Whitewater is currently under investigation by the U.S. Department of Education for allegedly mishandling sex abuse complaints. This was all over the news last week. According to news reports, the college has been reported in yet another matter for mishandling a sex abuse complaints. It feels as though I'm just another statistic of complaint mishandling by this careless and crummy university.
