I am a California resident and my husband and I have been defrauded and scammed out of $80,000 of equity from our home. A former real estate agent forged the signatures of the buyer, seller, and the public notary's signatures. This entire loan was unauthorized. There was never any disclosure from the real estate agent, the lender Home American Credit and nor was there ever any disclosure from the escrow compnay Fidelity National Title.

No one from any of these companies "ever" contacted the buyer or seller during the opening or closing of escrow, and nor did anyone ever inform me of a new loan on my home. Also someone from Fidelity National Title wired the proceeds from my home directly into the real estate agents bank account without authorization. Fidelity National Title failed to verify authentic signatures, and I was later told by the escrow manager that that was not their job to sit their and verify if all the signatures were authentic and matched. In addition escrow took unauthorized fees too.

The lender Home American Credit aka American Business Financial Services aka Upland Mortgage took over $20,000 in closing cost without authorization, which were excessive fees. The parent company and its subsidiary companies are aware of the entire fraudulent transaction, but refuses to settle this matter. The lender has refused to cooperate with me by placing my loan back to its original loan amount of 340,000, regardless of the fact that this was a fraudulent real estate tranaction, I never signed a loan application with any of their companies, I never siged or gave authorization for the companies to run my credit, an addendum is forged, and the signatures of the buyer, seller, and public notary are not of authentic signatures. This company has not complied with any of my demands, but has had the audacity to threaten me with foreclose on my property.

Contact your local FBI office. They have an entire department dedicated to fraud/identy theft. If this loan was originated without your acknowledgement, then the perpetrators committed identy theft. The FBI will further investigate and bring your thieves to justice.
