I called us auto credit to confirm that my next payment was my last. I was informed that i had accured over $200 in additional interest due to extra interest charged DAILY on every payment that was not received by the due date. the truth in lending disclosure in my contract calls for a late payment fee of $6.00 or .5% of the payment which ever is less. in my state any fee imposed that is not disclosed in the contract is a violation of the law as well as federal law. sec 808 15usc(1692f). these people have nerve and prey on people who won't stand up to them. I intend to do just that and i'm sure i'm not the only borrower this has happened to.

 First of all if you intend to "stand up to them", realize that you will loose.  Not only do they still have the right to Reposess your car, they can sell it at auction(which gets about 1/3 to 1/2 of "blue book" value).  The only good news in this is that unless your car is a total junker, after they take out the amount due, the repo and auction fees, you may get a few hundred dollars back.

Now, as to the rest of your report..

You quoted 808 15USC(1692f)..do you even know what that is or are you just throwing a bunch of numbers and letters together.  Because that is what is known as the Fair Debt Collection Practices Act(FDCPA).  That ONLY applies to 3rd Party Collection Agencies, that is companies that PRIMARY function is to collect bad debts for other companies.  Your Auto Loan company is considered an "Original Creditor" therfore the FDCPA does NOT apply to them.

Next on your late payment FEE...yes the FEE may only be $6.00 or 0.5% of your payment amount(which ever is less).  But that does not excuse the additional INTEREST that can be assessed.  Yes..this may be a shock to you but INTEREST is NOT a FEE.  So if your loan documents talk about how interest is assessed...you are going to owe it.

If you REALLY want to "stand up to them"...then at least do it smart.  That is pay the amount due, get your title, and then go after them AFTER the fact.  You will still probably loose but at least you won't be doing it without a car.
