On March 24,2012 my husband fell out of a tree 25-30 feet & broke both legs & his back. He was in a wheelchair for over 4 mos & on crutches for another 4 mos. He's had 5 surgeries so far. I worked 3 jobs ( 2 of which were full time), trying to make the bills.  Because my husband had just started a new job, he had no insurance & no type of time off w/pay; & because it happened while on my brother's property he couldn't get workman's comp & my brother's homeowners insurance refuses to pay any of the expenses stating it wasn't negligence.  So, we drained our savings, sold everything we had & borrowed from everyone we could just to try to pay bills. I immediately contacted US Bank to request to get our loan modified as I knew my husband would be off of work for quite awhile, & explained what was going on & requested a workout package so I could get a head start so that when I had exhausted all of our money we would have a backup plan.  

Well, after almost 2 years we are no further at having our loan modified as we were back in  April of 2012. To make things worse: I got hurt on MY job on January 20,2013: ended up having surgery on May 6,2013 & was fired on May 8,2013. So we were down to both of us being off of work! I did still have my daycare that I ran; but because of my surgery & not being able to lift more than 2-3pounds: I was down to one kid & only half days so I was only mmaking $90/week. All while trying to raise our 9 year old Granddaughter whom we've had since she was 2 days old. My husband found out he would never be able to work again due to the extent of his injuries. Did I nention we both are only 49 years old. Then I found out, right before I turned 49 that I had something called CRPS. A result of the injury from work. If you research it, it is a very painful, disabilatating disease that only gets worse over time. I cannot lift anything over 3-5 pounds & am in constant pain & am not able to do 3/4 of the things I once did or the normal things people do on a daily basis. To top it all off, the day before Christmas Eve: we get a letter in the mail from US Bank's attorney stating they are doing a Sheriffs sale on January 10,2014 at 10:30am.  Great Christmas present.

After the initial shock, I called Tania Daniels,  our "representative manager" & asked what was going on as she had been telling us all along not to worry that everything was fine & we had nothing to worry about.  She stated again, not to worry & that it had been postponed to Feb 26,2014; but then if the modification hadn't went thru they would postpone it again. All along, every month I was sending in bank statements, profit & loss statements,  hardship letters, checkstubs, household expenses: all dated & signed.  About every other month or so, they would have us fill out the ENTIRE packet AGAIN!! We did everything they asked, provided them w/all paperwork: although they'd state half the time they didn't recieve it so we'd have to fax it all over again & again!!! So, a couple of weeks ago; we AGAIN: got another letter stating the Sheriff sale was for February 26,2014 at 10:30am. So I again called Tania.  At first she denied it, stated it had been postponed.  But when I asked when it was postponed to, she then needed my loan number: so I gave her that & have not heard back from her since! That was over a week ago!!  Pretty sure all US Bank is doing is stringing us along & will boot us out w/out any notice. We told them in the fall if that was the case just tell us so we could move & get all of our stuff out. Now everything is frozen in. They just didnt want to pay someone to maintain the house over the winter.

I've spoke w/a Keri from the Fair Housing Authority & she checked into it & even said there is no reason why they aren't working w/us & that we qualify for the programs. But now for some reason she won't even talk to us???? I will find someone to help us; its not right what they are doing.  They are receiving money both from the government to help peopkelike us out who are facing hardships, pplus they are taking money from insurance companies for foreclosure insurance all the while when they claim they are "working w/us to try to get a modification" they are getting  mortgage insurance.  That is Fraud anyway you look at it & I hope they fry for it. Afterall they don't feel bad doing what they are to my family & me or any of the other thousands of people they are scamming!!! They need to be stopped! SOMEONE PLEASE HELP:(

It is a shame that consumers, including myself, who are going through the loan modification process have to continously resubmit paperwork.  Unfortunately, my mortgage point person,Jarvis, has contacted me recently to request additional paperwork for form 4506T requesting all parties to sign this document.  I have signed this document on three occasions and I am the only person titled on the mortgage.  Quite frankly after missing no payments and experiencing unemployment, I believe U.S. Bank simply wants to foreclose on the property. They are trying to suggest that other people need to sign form 4506T.  I am not in foreclosure but am trying to be proactive at this time.  It has been about two years and still no loan modification plus no missed payments.  There packet actually has changed during the past two years which the lender had to do because the packet is not self-explanatory.

It was explained to me that the reason why documents are requested over and over again is because the dated and signed documents expire.  The only way these documents expire is because of bank processing time frames or rather incompent employees. Documents are submitted in a timely manner within 30 to 45 days and the lender simply is backed logged with requests.   I went inside to a U.S. Bank financial institution and let them fax the loan modification forms to the home mortgage loan modification department.  And, of course the documents where requested again and I received another loan modification packet.  

I am suspicious because I was contacted by a lawyer in Philidelphia requesting information about overdraft fees. Apparently, some one is trying to sue U.S. Bank Home Mortgage for excessive or unusual mortgage fees.  I am also suspicous because I requested to be assigned to a different mortgage point person and to speak to a supervisor.  Jarvis refused to transfer the call.  I will be contacting the BBC shortly and researching lender lawsuits.
